AMENDMENT No.3 TO CITY SECRETARY CONTRACT WHEREAS, the City of Fort Worth (CITY) and Alan Plummer Associates, Inc. , (ENGINEER) made and entered into City Secretary Contract No. 38536, (the CONTRACT) which was authorized by M&C C-38536 on the 31st day of March, 2009 in the amount of $889,676.00; and WHEREAS, the CONTRACT was subsequently revised by: Amendment No. 1 in the amount of $79,414 .00 which was authorized by M&C C-24626 on December 7, 2010 and Amendment No. 2 in the amount of $4081795.00 which was authorized by M&C C-28193; and WHEREAS, the CONTRACT involves engineering services for the following project: Sanitary Sewer Main 257 Upper and Middle Village Creek Parallel Relief Main Part 2; and WHEREAS, it has become necessary to execute Amendment No. 3 to the CONTRACT to include an increased scope of work and revised fee. NOWTHEREFORE, CITY and ENGINEER, acting herein by and through their duly authorized representatives, enter into the following agreement, which amends the CONTRACT: 1 . Article I of the CONTRACT is amended to include the additional engineering services specified in a proposal dated January 8, 2018 a copy of which is attached hereto and incorporated herein. The cost to City for the additional design services to be performed by Engineer total $90,740.00. 2 . Article II of the CONTRACT is amended to provide for an increase in the fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall be an amount of $1,468, 625.00 . Contract Amendment No.3 Dear Mr.Kasavich: This Contract Amendment No.3 is provided for the detailed design of the Upper and Middle Village Creek Sanitary Sewer M-257 Relief Pipeline,Part 2. The detailed scope for Contract Amendment No. 3 is attached to this letter. This amendment Is necessary to collect topographic survey and to evaluate impacts of field changes at three ponds along the alignment on the design and other design changes. The Engineer will perform the work outlined below. 1) Modify plans to reflect new topographic conditions. 2) Modify plans to reflect new pipe size. 3) Manage survey sub-consultant 4) Update siphon design calculations based on new pipe sizes at two siphons. 5) Additional Easement staking for land appraisal support. 6) Additional coordination with Property Management Staff,preparation of exhibits,supporting documents. 7) Additional meetings for design reviews,junction box operations and shapes,property management support and project management. 8) Additional Access location evaluation,easements and coordination. 9) Additional Permanent easements south of Burleson Retta Road. Additional Survey & Easement Acquisition Assistance 12/18/2017 The City of Fort Worth has requested the following special services from Alan Plummer Associates, Inc. These services are related to additional assistance for easement acquisition and encroachments on the existing easements along the route of the pipeline. The additional scope is as follows: Congregation of the Mother Coredemptrix/Holy Family Religious & Retreat Center Property. 1) Additional coordination meetings with City staff (3) for encroachment of the pond on the parcel owned by Holy Family Religious & Retreat Center. 2) Site Survey of Pond Retreat Center. The topographic survey will be collected twice, once for existing conditions and in the future once the easement is restored (if authorized). Review sub-consultant deliverables, and manage survey sub-consultant. 3) Perform section cuts based on the new topo to illustrate cover and separation distances to the new pond slope. 4) Prepare new access easement on Retreat Center Property. Todd Dunham Property 1) Additional coordination meetings with City staff (1) for encroachments of the ponds on the parcel owned by Todd Dunham. 2) Site Survey of Pond on Todd Dunham Property. The topographic survey will be collected twice, nee for existing conditions and in the future once the easement is restored (if authorized). Review sub-consultant deliverables and manage survey sub-consultant. 3) Perform section cuts based on the new topo to illustrate cover and separation distances to the new pond slope. Southern Oaks Golf Course Property 1) Additional coordination meetings with City staff (2) for encroachment of the ponds on the parcel owned by Southern Oaks Golf Course. 2) Site Topographic survey of pond and electrical conduit on Southern Oaks Golf Course. The topographic survey will be collected twice, once for existing conditions and in the future once the easement is restored (if authorized). Review sub-consultant deliverables and manage survey sub-consultant. 3) Perform section cuts based on the new topo to illustrate cover and separation distances to the new pond slope. 4) Modification to the alignment along Southern Oaks Golf Course to avoid Tee Box. 5) Revise Permanent Easement documents for three Parcels south of Burleson Retta Road to include the existing pipeline in the limits of the easement. Additional Survey & Easement Acquisition Assistance 12/18/2017 Other Items: 1) Assist the City with preparing special language, exhibit for offer letters for easement acquisition for parcels which have not had easements secured prior to August of 2017. Including preparing exhibits related to Access Road details, utility locations exhibits, sanitary sewer services, document containing Frequently Asked Questions answering property owners questions and power point presentation for Public Meetings (2). This task includes a detailed project construction sequencing to identify timeline of construction on each parcel and the sequence of construction dependence on the access locations and project permitting. 2) Additional coordination with City staff for reviewing junction boxes, siphon design, property acquisition process, preparation of exhibits for land acquisition and city communication with property owners, additional thirty five meetings to coordinate with Property Management staff and coordinate with Field Ops staff and other coordination with City staff. 3) Modify siphon design based on revised pipe diameter to 42-inches for two siphons. 4) Modifications to pipe size from Station 177+00 to the end of the project. 5) Easement staking along pipeline route for up to 24,700 LF for the purpose of land appraisal, property owner coordination and field visits. This includes the staking of the edge of the temporary construction easement, the permanent easement and access easements at 200' Intervals or (nearest line of sight) and at HPI's. 6) Easement re-staking along pipeline route for up to 13,000 LF (Part 213) for the purpose of land appraisal, property owner coordination and field visits. This includes the staking of the edge of the temporary construction easement, the permanent easement and access easements at 200' Intervals or (nearest line of sight)and at HPI's. 7) Prepare updated access easement from McPherson Road along an alternative Route. 8) Additional Coordination for Permanent Access to Project Site. Compensation A. The ENGINEER shall be compensated a total lump sum fee of $90,740 as summarized in Exhibit B-1 —Engineer Invoice and Section IV—Summary of Total Project Fees. The total lump sum fee shall be considered full compensation for the services described in Attachment A, including all labor materials, supplies, and equipment necessary to deliver the services. B. The ENGINEER shall be paid monthly payments as described in Section II - Method of Payment. II. Method of Payment A. Partial payment shall be made to the ENGINEER monthly upon City's approval of an invoice prepared and submitted by the ENGINEER in the format and including content as presented in Exhibit B-1, Progress Reports as required in item III. of this Attachment B, and Schedule as required in Attachment D to this Agreement. B. The estimated current physical percent complete as required on the invoice shall be calculated from the progress schedule as required in Attachment D to this Standard Agreement and according to the current version of the City of Fort Worth's Schedule Guidance Document. C. The cumulative sum of such monthly partial fee payments shall not exceed the total current project budget including all approved Amendments. D. Each invoice shall be verified as to its accuracy and compliance with the terms of this Agreement by an officer of the ENGINEER. III. Progress Reports A. The ENGINEER shall prepare and submit to the designated representative of the Water Department, monthly progress reports and schedules in the format required by the City.
