HomeMy WebLinkAboutContract 26818 CITY SECRETARY CONTRACT NO. _ ASA STATE OF TEXAS § § KNOW ALL PERSONS BY THESE PRESENTS COUNTY OF TARRANT § AMENDMENT NO. 1 TO CONTRACT NO. 26683 BETWEEN THE CITY OF FORT WORTH, TEXAS, AND MATERIALS ANALYTICAL SERVICES, INC. (MAS) FOR LABORATORY SERVICES RELATING TO PROJECT XL PHASE I This agreement is entered into by and between the City of Fort Worth, Texas, a home- rule municipal corporation situated in Tarrant and Denton Counties, Texas, hereinafter called "City," acting herein through Charles Boswell, its duly authorized Assistant City Manager, and Materials Analytical Services, Inc. (MAS), hereinafter called "Contractor," by and through Mark W. Rigler, its duly authorized Vice President. Whereas, the City and Materials Analytical Services, Inc. have entered in an agreement identified as City Secretary Contract No. 26683 for the period beginning April 19, 2001 and ending April 18, 2002; and Whereas, it is the mutual desire of the parties to amend said City Secretary Contract No. 26683. In consideration of the mutual promises and benefits of this contract, the City and Contractor agree as follows: In consideration for the work performed by Contractor under this contract, the contract is hereby amended to increase the maximum "not to exceed" compensation for all services rendered under the contract for Phase I by $15,000.00 (fifteen thousand dollars) from $25,000.00 to $40,000.00. The additional payment shall be based on the unit price charge not to exceed $200.00 per sample for additional reading of the grids to reach the detection limit set by the Environmental Protection Agency (EPA). The foregoing amendment shall not affect the method or manner of payment of funding provided in the contract or any other amendment thereto. FOR ENVIRONMENTAL LABORATORY SERVICES FOR PROJECT XL RECOMMENDATION: It is recommended that the City Council authorize the City Manager to execute an amendment to City Secretary Contract No. 26683 with Materials Analytical Services, Inc. to increase the not-to-exceed amount from $25,000 to $40,000 in connection with Project XL. DISCUSSION: On March 27, 2001 (M&C C-18519), the City Council approved award of a contract to Materials Analytical Services, Inc. for the provision of environmental laboratory services in connection with Phase I of Project XL, the demolition of 2615 Ennis Avenue. During the week of April 23 through 27, 2001, the Phase I demolition property (2615 Ennis Avenue) was torn down, and during the process some 69 air samples were taken and sent to the lab for testing. Due to variable weather conditions, the volume of air Collected through the samplers was less than expected. As a result, the laboratory must increase the number of readings for each sample in order to reach the detection level set by the Environmental Protection Agency (EPA). In order to get the results the EPA desires, the lab must look harder for asbestos in the samples submitted, which will require additional effort and analysis levels. The increased cost is approximately $200 per sample. The demolition cost was nearly $20,000 less than what was originally estimated, therefore this contract increase does not require additional funds for the project's total cost of $69,900. The provisions of Chapter 252 of the Texas Local Government Code do not apply because this is a "procurement necessary to preserve or protect the public health or safety of the municipality's residents." An MNVBE subcontracting goal for this contract amendment does not apply. FISCAL INFORMATION/CERTIFICATION: The Finance Director certifies that funds are available in the operating budget, as appropriated, of the Environmental Management Project Fund.
