HomeMy WebLinkAboutContract 50105-A2 AMENDMENT No.2 CITY SECRETAR( CONTRACT NO, TO CITY SECRETARY CONTRACT No. 50105 WHEREAS, the City of Fort Worth (CITY) and Lee Engineering, LLC, (ENGINEER) made and entered into City Secretary Contract No. 50105, (the CONTRACT) which was authorized by M&C on the 12th day of December, 2017 in the amount of $ $158, 901 . 58; and WHEREAS, the CONTRACT was subsequently revised by: Amendment Number 1 in the amount of $22, 190 . 25 which was administratively authorized on April 4, 2018; and WHEREAS, the CONTRACT involves engineering services for the following project: 2014 STREET LIGHTING PROGRAM YEAR 4 - Overton Park Drive East and North Beach Street; and WHEREAS, it has become necessary to execute Amendment No. 2 to the CONTRACT to include an increased scope of work and revised fee. NOW THEREFORE, CITY and ENGINEER, acting herein by and through their duly authorized representatives, enter into the following agreement, which amends the CONTRACT: 1 . Article I of the CONTRACT is amended to include the additional engineering services specified in a proposal dated April 2q, 2018, a copy of which is attached hereto and incorporated herein. The cost to City for the additional design services to be performed by Engineer totals $9, 885. 00. (See Attached Funding Breakdown Sheet, Page -3-) 2 . Article II of the CONTRACT is amended to provide for an increase in the fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall be an amount of $190, 926. 83. 3 . City of Fort Worth—Transportation and Public Works Department 200 Texas Street Fort Worth,Texas 76102 Re: Amendment#2 CSN 50105—2014 STREET LIGHTING PROGRAM YEAR 4—Overton Park Drive E & North Beach Street Dear Clint: Lee Engineering, LLC("LEE"or"Consultant")is pleased to submit this Amendment#2 to the City of Fort Worth (City) to provide additional services to design additional street lighting improvements along Overton Park Drive E. Project Understanding The nature of the proposed lighting improvements for Overton Park Drive E has changed after input on the 30% design. The new scope includes design and installation of 38 new black powder coated, Utility Washington poles with underground electric along the west side of the roadway for the majority of the length. The final three poles will be set on the east side of the roadway to avoid private property conflicts. Phase 1 of the construction will consist of conduit and wiring for all 38 poles and the installation of 19 poles and foundations—or every other pole. Phase 2 (not currently funded)will install the foundations for the in- fill poles at a later date. This change was formally made on March 19, 2018 as directed by the property owners present at the public meeting held that evening and is supported by Councilmember Byrd. The project limits and scope of services for the N Beach Street portion of the project (as revised under Amendment#1) remain unchanged. Scope of Services The following Scope of Services has been developed based on our discussions with the City. LEE will provide the services specifically set forth below. Rather, 38 poles will be laid out on a general spacing of between 125-150 feet, as specified by the City. At one location near the southern project limits where Overton Park Drive E crosses a bridge over the creek, 190- foot spacing will be provided. LEE will incorporate the results of a City "walk through" field visit in conjunction with TPW staff to identify preliminary pole locations and any other features of concern so they can be incorporated into the public meeting presentation materials and the 90%design submission. Task 3—Draft Final Design (90%) LEE will design the proposed lighting system and produce plan sheets for all items included in the contract scope of work for the project area on Overton Park Drive East. An additional overview plan sheet will be provided to illustrate the layout of all 38 Phase 1 and Phase 2 poles, with explanatory notes indicating the separate nature of Phase 2 apart from the subject project. Conduit and cable charts and voltage drop calculations will account for both Phase 1 and Phase 2 improvements. The remainder of the plan sheets, lighting layouts, streetlight summary, quantities, specifications, and an updated opinion of probable construction cost will exclude the Phase 2 poles and fixtures. Additional Services Any services not specifically provided for in the above scope will be billed as additional services and performed at our then current hourly rates. Schedule We will provide our services in a mutually agreed upon schedule following Notice to Proceed from the City. Additional services, if desired, will be performed in a timely manner upon authorization by the City. Fee and Expenses LEE will perform the services in Tasks 1-3 for a not-to-exceed fee of$9,885.00. All permitting, application, and similar project fees will be paid directly by the Client. LEE will not exceed the total maximum labor fee shown without authorization from the Client.
