MODIFICATION OF LEASE AGREEMENT THE STATE OF TEXAS KNOW ALL BY THESE PRESENTS COUNTY OF TARRANT THAT this Modification of Lease Agreement is made and entered into between Roosevelt Burrell,d.b.a.Cowtown Traffic Control("Lessor")and the City of Fort Worth, a municipal corporation,acting by and through its duty authorized representatives ("Lessee")for and in consideration of One Dollar($1.00)and other good and valuable consideration,receipt of which is hereby acknowledged. WITNESSETH 1. Lessor and Lessee hereby confirm and ratify,except as modified below,all of the terms,conditions and covenants in that certain Lease Agreement for office space, signed on August 25, 1999,City Secretary Contract No.25179,and the renewal of lease letters for approximately 560 square feet of office space located at 4603 Home Street,Fort Worth,Tarrant County,Texas 76109. 2. Lessor and Lessee agree that effective August 16,2005 the Lease shall be extended for a term of one(1)year and shall expire on August 15 2006. 3. Lessor and Lessee agree that the City of Fort Worth may renew the Lease for successive terms of 12 months each up to a maximum of two(2)successive terms. 4. Lessor and Lessee agree that for the term effective August 16,2005 and any subsequent extensions of the Lease the rental payment shall be$270.00 per month. 5. Authorize the City Manager to execute a lease extension for office space located at 4603 Horne Street from Roosevelt Burrell d/b/a Cowtown Traffic Control at a cost of$3,240.00 per year; and 2. Approve the lease extension term of one year beginning August 16, 2005 and expiring August 15, 2006, with two options to renew for one year each. DISCUSSION: The Engineering Department, Real Property Services Division, at the request of the Police Department, negotiated a lease extension with Roosevelt Burrell d/b/a Cowtown Traffic Control for office space to be utilized as a police storefront. The lease extension term is for one year, with two one-year options to renew. This lease will reflect an increase in rental payments from $250.00 to $270.00 per month. The City has leased this space since August 16, 1994 and is responsible for the payment of telephone and utility services. RENEWAL OPTIONS — This agreement may be renewed for up to two successive one-year terms at the City's option. This action does not require specific City Council approval provided that the City Council has appropriated sufficient funds to satisfy the City's obligation during the renewal term. This property is located in COUNCIL DISTRICT 7. FISCAL INFORMATION/CERTIFICATION: The Finance Director certifies that funds are available in the current operating budget, as appropriated, of the Crime Control and Prevention District Fund.
