HomeMy WebLinkAboutContract 32411-A8 AMENDMENT NO. 8 TO AGREEMENT FOR ARCHITECTURAL DESIGN SERVICES NEIGHBORHOOD POLICE STATION AND TRAFFIC DIVISION FACILITY STATE OF TEXAS § 30,1q11 y� § CITY SECRETARY CONTRACT NO. `rl COUNTY OF TARRANT § WHEREAS, The City of Fort Worth and Perkins Will (Architect) made and entered into City Secretary Contract No. 32411 (The Contract) which was authorized by the City Council by M&C C-20926, the 30th day of August, 2005; and WHEREAS, further amendment is necessary to reimburse the Architect for additional Construction Administration services the Architect incurred during the delayed-construction schedule period for the new Nashville NPD#6 and Traffic Division facility. NOW THEREFORE, City and Architect, acting herein by and through their duly authorized representatives, enter into the following agreement which amends the Contract: 1. Article 1.1, SECTION I -SERVICES OF THE ARCHITECT, a paragraph is added to read as follows: "Provide additional Construction Administration services for the construction schedule delays beyond the original project completion date. The cost of this additional service is$96,496.62 total. The scope of services is described more fully in the following Perkins+Will letter dated: January 11, 2011 reference: Additional Services Proposal - Construction Scheduled Delays, Nashville NPD6 Traffic Facility and City of Fort Worth letter dated: November 22,2010 reference: Additional Services Proposal - Construction Schedule Delays (Nashville NPD6 and Traffic Facility), which are attached hereto respectively as Attachment"A" &"B" and made a part of this Agreement." 2. Paragraph 1 of SECTION V- COMPENSATION TO ARCHITECT, is amended as follows: "The total compensation for all of the assignments to be performed by Architect as described in CHARACTER AND EXTENT of ARCHITECT'S SERVICES hereof shall be a fixed fee of $934,571.62 plus up to $56,948.31 in reimbursable expenses." 3. I have also researched your justification to reduce our original requested amount of$140,542.50 to the approved $96,496.62 and accept your revised amount. I appreciate your thoughtful consideration of this matter and your fairness. The Notice-to-Proceed was issued on January 29,2009 with the start date of February 13,2009 and the completion date of April 19,2010 with a performance period of 430 calendar days. Phase I was the completion of the new facility and some parking and Phase 11 being the demolition of the existing facility and completion of the remaining parking. We estimate that the completion date will be January 2011. Your request is for 999.50 additional hours(or 125 work days or 35 weeks)for$140,842.50 beyond the original April 19,2010 completion date. Many of the scope delays were attributable to the general contractor but there were some delays due to design issues;such as,the glazing,plumbing,above ceiling coordination,sunshade/w[ndow glass details,and mil[work. The glazing performance specification did not have enough details and description. Also,there was not any discussion during the PreAward evaluation phase with the Schedule of Values and the glazing number. We checked with our Legal Department and the decision was that the performance specification did not have enough details. The plumbing issues involved PVC(as designed)versus the City standard metallic(copper or cast iron)for water supply,drains,and gas supply line. There were three other design issues: the use of FRP paneled walls in the shower stalls versus the City standard ceramic tile walls;the redesign of the sunshade/window glass details to stop the leaking;and the use of particle board for millwork. The above ceiling coordination was also a design coordination issue of 9'-8"duct height versus 10'-0"ceiling height. We find it difficult to go backwards now and go through the additional hours requested. We estimate that the above design issues attributed to 10 weeks of delays. We propose the additional fees of$96,496.62 for construction administrative(CA)services through December 2010. The calculation is based on your original CA from February 13,2009—February 12,2010(52 weeks for$152,055.00). The additional amount is based on additional 30 weeks of CA from February 13,2010—September 7,2010 estimated Substantial Completion($87,72420);minus 10 weeks due to design issues addressed above(-$29,241.40);and additional 13 weeks of CA from September 8,2010— December 15,2010($38,013.82). DISCUSSION: On August 30, 2005, (M&C C-20926)the City Council authorized the City Manager to execute a professional services agreement in the amount of$300,000.00 with Perkins+Will to program and design the Nashville Neighborhood Policing District No. 6 and Traffic Division facility. Amendments No. 1, 2, 4 and 5 were authorized by M&C's C-22276, C-22404, C-23259, C-23801 respectively. Amendments No. 3, 6 and 7 ($18,950.00.total)were administratively executed. On November 11, 2008, M&C C-23182 authorized execution of a construction contract($8,216,000.00) with Crossland Construction Company, Inc., to construct the facility.The total funding available from all sources is$12,522,000.00.The source of the funding is$332,000.00 from the Crime Control and Prevention District(CCPD), $40,000.00 from the Police Department General Fund, and $12,150,000.00 from Critical Capital Needs Certificate of Obligation, Series 2007 and 2008. Amendment No. 8 in the amount of$96,496.62 to the professional services agreement with Perkins+Will is necessary to extend the service period for the construction administration services through January 2011. The overall project cost is estimated to be: Design $ 991,519.93 Construction $ 8,301,973.00 ITS, Geotech, Demolition $ 1,740,000.00 Contingency, FF&E, Staff Administration $ 926,507.07 Total $ 11,960,000.00 A waiver of the goal of M/WBE subcontracting requirements was requested by the department and approved by the M/WBE Office because the purchase of goods and services is from sources where subcontracting or supplier opportunities are negligible. The project is located in COUNCIL DISTRICT 8. The completion of the facility will add 30,074 square feet to the City's facility inventory and add approximately$10,000.00 per year in the facility maintenance and repair requirements.
