CITY OF FORT WORTH CITY SECRETARY TO CITY SECRETARY CONTRACT WHEREAS, the City of Fort Worth (CITY) and Lockwood, Andrews & Newnam, Inc. , ENGINEER) made and entered into City Secretary Contract No. 45280, (the CONTRACT) which was authorized by M&C C-26567 on the 19th day of September, 2013 in the amount of $575,828.00; and WHEREAS, the CONTRACT was subsequently revised by Amendment No. 1 in the amount of $168,311 .00 which was authorized by M&C C-26964 on September 9, 2014 and Amendment No. 2 in the amount of $839,175 . 00 which was authorized by M&C C-28712 on June 5, 2018; and WHEREAS, the CONTRACT involves engineering services for the following project: Sycamore Creek Drainage Basin Parallel Interceptor Improvements at Various Locations with the Sycamore Creek Drainage Basin WHEREAS, it has become necessary to execute Amendment No. 3 to the CONTRACT to include an increased scope of work and revised fee. NOWTHEREFORE, CITY and ENGINEER, acting herein by and through their duly authorized representatives, enter into the following agreement, which amends the CONTRACT: 1 . Article I of the CONTRACT is amended to include the additional engineering services specified in a proposal dated April 18, 2018, a copy of which is attached hereto and incorporated herein. The cost to City for the additional design services to be performed by Engineer totals $215,030 . 00 . 2 . Article II of the CONTRACT is amended to provide for an increase in the fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and s an amount of $1,798,884 .00 . A LEO A DALY COMPANY April 18, 2018 City of Fort Worth I Water Department Attention: Liam Conlon 1000 Throckmorton St. Fort Worth, Texas 76102-6311 RE: REQUEST FOR CONTRACT AMENDMENT 3 City of Fort Worth Project 02200 Sycamore Creek Interceptor Rehabilitation Dear Mr. Conlon: A conceptual route study for all phases of the Sycamore Creek relief interceptor (totaling approximately 22,500 LF) was previously prepared and submitted to the City in August 2014 under the original contract agreement. In the time since, Amendments 1 and 2 have been approved as follows: • Amendment 1 allowed for additional coordination with the Park and Recreation Department (PARD) for rehabilitation design of the existing pipeline. • Amendment 2 allowed for the design, bidding and construction phase services for the first 5,900 linear feet of a relief/parallel interceptor as one phase. In 2017, in an effort to expedite construction on a portion of the project that does not require railroad permitting, the first 5,900 feet of the relief/parallel interceptor project was divided into two phases that will be bid and constructed separately. Through additional negotiations with PARD, Phase 2 will now require adjustment of a portion of the alignment through the Sycamore Creek Golf Course and an additional 400 linear feet of interceptor to cross Vickery Drive and enter Sycamore Park. Also, per additional discussion with PARD, Phase 2 of the project will now require two parks conversions, resulting in additional coordination for the design and construction of the project. The task/hour breakdown for specific activities within this requested Amendment 3 is attached, but, in summary, the following items are included in this request of $215,030: • Preliminary (60%) Design ($59,000) • Final Design (90%) and Final Construction Documents ($38,250) • Bid Phase Services ($12,750) • Construction Phase Services ($42,100) • Survey and Subsurface Utility Engineering Services ($22,750) • Parks Coordination ($40,180) The following presents the project fee summary to date, including this request: Original Contract $ 575,828 Amendment No. 1 $ 168,311 Amendment No. 2 $ 839,715 Amendment No. 3 $ 215,030 Revised Contract Amount $ 1,798,884 1320 South University Drive • Fart Worth,Texas 76107 • 817.820.0420 • Fax:817.820.0441 • www.lan-inc.com Liam Conlon, Project Manager City of Fort Worth April 18, 2018 Page 2 As noted on the attached breakdown, the additional effort associated with tasks above totals $215,030. Of this, 11.5% ($24,750) is proposed to be performed by small business partners included in our original Project Team. The tasks are summarized as follows: • Task 3 —This task provides for the preliminary design (60%) of the additional length of interceptor that crosses Vickery Drive and extends into Sycamore Park, ending at a new interconnection with the existing interceptor that will require a new junction box design after the PARD requested change in alignment. This task also provides for other work associated with the redesign of southern portions of the Phase 2 alignment that were adjusted per PARD comments after the 90% submittal. • Task 4 — This task combines the effort to prepare and resubmit the final design (90%) documents along with complete construction documents for the redesign of the Phase 2 alignment beginning at the siphon and continuing upstream, including the additional length of pipe to cross Vickery Drive and extend south into Sycamore Park, ending at the new interconnection junction box that will be coordinated with City of Fort Worth Operations. Also included in this task is pavement evaluation and modification of plans to accommodate TPW. • Task 5 — As Amendment 2 provided bid phase services for the first 5,900 linear feet as one project, this task provides for additional bid phase services with the 5,900 linear feet being bid in two phases. • Task 6 — As Amendment 2 provided construction phase services for the first 5,900 linear feet as one project, this task provides for additional construction phase services with the 5,900 linear feet being constructed in two phases. This task also provides an additional $10,000 per construction phase ($20,000 total) for additional site visits by LAN for observation and assessment of large diameter interceptor embedment, backfill, and compaction to ensure proper installation that minimizes deflection of pipe. • Task 8 — This task provides for additional SUE and surveying services required for the redesign as a result of the alignment change within Sycamore Creek Golf Course. The additional survey and SUE services are required to locate existing underground utilities and obstacles to complete final design of the new portion of work within Sycamore Creek Golf Course and Sycamore Park. • Task 10 — This task provides for the additional coordination and design with the City of Fort Worth Park and Recreation Department. This provides for site visits to review staked alignments, the preparation of PARD requested exhibits, and the meetings and coordination required for the preparation and submittal of two separate Park Conversions (Sycamore Creek Golf Course and Sycamore Park). Adopt the attached Resolution expressing official intent to reimburse expenditures with proceeds of future enterprise fund debt for the Sycamore Creek Drainage Basin Parallel Interceptor Improvements Project; 2. Adopt the attached Appropriation Ordinance reducing unallocated receipts and appropriations in the Water and Sewer Commercial Paper Fund in the amount of$255,030.00, for the Sycamore Creek Drainage Basin Parallel Interceptor Improvements Project; and 3. Authorize execution of Amendment No. 3, in the amount of$215,030.00, to City Secretary Contract No. 45280, an Engineering Agreement with Lockwood, Andrews & Newnam, Inc., for Sycamore Creek Drainage Basin Parallel Interceptor Improvements at various locations thereby increasing the contract amount to$1,798,884.00. (City Project No. 02200) DISCUSSION: On November 19, 2013, (M&C C-26567) City Council authorized an Engineering Agreement with Lockwood, Andrews & Newnam Inc., in the amount of$575,828.00 for the Sycamore Creek Drainage Basin Parallel Interceptor Improvements at various locations within the Sycamore Creek Drainage Basin. The Agreement was subsequently revised by Amendment No.1 (M&C C-26964) September 9, 2014 in the amount of$168,311.00 and Amendment No. 2 (M&C C-27884) August 23, 2016 in the amount of $839,715.00. Amendment No. 3 will provide for the following: Redesign of the portion of the sewer main across Sycamore Golf Course as requested by the Park and Recreation Department. • Design of a sanitary sewer interceptor to cross Vickery Boulevard and into Sycamore Park. . Park conversions for Sycamore Golf Course and Sycamore Park. . Design survey. • Subsurface utility engineering. . Assistance during construction. Lockwood, Andrews & Newnam, Inc., proposes to perform the necessary additional work for a lump sum fee of$215,030.00. In order to expedite construction, the project was divided into two phases: Phase 1 from Gateway Park southwards to Union Pacific Railroad Right-of-way has been advertised for bid; Phase 2 from Union Pacific Railroad Right-of-way will be revised via this amendment. This project is part of the Water Department' s Sanitary Sewer Overflow Initiative Program. This project is anticipated to be included in a future revenue bond issue for the Water and Sewer Fund. Available cash within the Water and Sewer portfolio and the City's portfolio along with the appropriation authority authorized under the Callable Commercial Paper Program (CP)will be used to provide interim financing for this project until debt is issued. To the extent resources other than the Water and Sewer portfolio are used to provide interim financing, the Water and Sewer Fund will be charged interest that is equivalent to the overall rate of return being earned by the City portfolio (currently approximately one- percent annually). Should the City's portfolio not support the liquidity needed to provide an interim short- term financing source, another funding source will be required, which could mean issuance of securities under the CP Program or earlier issuance of Water and Sewer revenue bonds than is currently planned. Once debt associated with this project is sold, bond proceeds will be used to reimburse the Water and Sewer portfolio and the City's portfolio in accordance with the attached Reimbursement Resolution. The City Council adopted the Water Department's Fiscal Year 2018-2022 Five Year Capital Improvement Plan on December 12, 2017, Mayor and Council Communication (M&C G-19187). This City Council adopted plan includes this specific project, with funding identified through the CP program to be reimbursed with future revenue bonds. In accordance with the provisions of the Financial Management Policy Statement, Staff anticipates presenting revenue-supported debt issuances to the City Council for consideration within the next three years. This debt must be issued within approximately three years to provide reimbursement for these expenses. If that does not occur, the costs will no longer be reimbursable by issuing tax-exempt debt and the funding source will have to be made whole through budgetary methods. Adoption of this resolution does not obligate the City to sell bonds, but preserves the ability to reimburse the City from tax-exempt bond proceeds. This project will have no impact on the Water Department's operating budget when complete. Design for the Phase 2 project is expected to be complete by May 2019 with construction starting in September 2019 and completion by June 2021. M/WBE OFFICE: Lockwood,Andrews & Newnam, Inc. is in compliance with the City's BDE Ordinance by committing to 12 percent SBE participation on this Amendment No. 3. The Water and Sewer Commercial Paper Fund includes authority of$150,000,000.00 for the purpose of providing interim funding for Water and Sewer Capital Projects. After this transfer, the balance will be $139,589,970.00 for future capital projects.
