WHEREAS, the City of Fort Worth (City) and Pate Engineers, Inc.
(Engineer) made and entered into City Secretary Contract No. 29041,
(the Contract) which was authorized by the City Council by MSC C-19719
on the 19th day of August, 2003; and subsequently revised by two
previous amendments; and
WHEREAS, the Contract involves engineering services for the
following project:
Water and Sanitary Sewer Replacement Contract 2003 STM-E
WHEREAS, it has become necessary to execute Amendment No. 3 to
said Contract to include an increased scope of work and revised
maximum fee;
NOW THEREFORE, City and Engineer, acting herein by and through
their duly authorized representatives, enter into the following
agreement which amends the Contract:

Article I of the Contract is amended to include the additional
engineering services specified in a proposal letter dated June 14,
2005, a copy of which is attached hereto and incorporated herein. The
cost to City for the additional design services to be performed by
Engineer total $6,545.00.

Article II of the Contract is amended to provide for an increase
in the maximum fee to be paid to Engineer for all work and services
performed under the Contract, as amended, so that the total fee paid
by the City for all work and services shall not exceed the sum of
$180,921.74 .

All other provisions of the Contract which are not expressly amended
herein shall remain in full force and effect.

Dear Mr. Conlon:
We would like to request that an amendment be granted for the above referenced project
in the amount of $ 6,250.00. This request is based on the decision to modify the
construction plans to ensure an uninterrupted flow of water to a cola bottling plant during
construction. Reaching this decision involved meetings with the plant manager and city
officials. We have provided color sketches to assist in these meetings. The modifications
include phasing a portion of the construction so that water continues to run in the existing
line to be replaced until the new line is in service. Even with these design changes the
contractor will have to work with the plant to schedule when service is switched because
the plant tends to run nearly 24 hours a day for almost 7 days a week. Once we received
a final directive, Pate made the necessary changes to the plan sheets. Pate will meet with
the two city officials responsible for the project design and approval of the modifications
and make any requested adjustments one time prior to signing, sealing and releasing to
the contractor for construction.
The M/WBE subcontractors should not be affected and the specified amount for their
portion of our contract does not need to change. The amendment costs break out as
follows:

we have already completed the needed modifications to the plan sheets and the contractor
