HomeMy WebLinkAboutContract 48675-A1 f CITY SECRETARY 7 CONTRACT NO. � — AMENDMENT TO 2018 �° CITY SECRETARY CONTRACT NO. 48675 INTERLOCAL AGREEMENT CIA , Cly 5CCFt�AR Is FOR RABIES CONTROL BETWEEN Ct CITY OF FORT WORTH AND TARRANT COUNTY THIS AMENDENT AGREEMENT TO CITY SECRETARY CONTRACT (CSC) NO. 48675 is made and entered into by and between the CITY OF FORT WORTH, a home-rule municipal corporation situated in Tarrant, Johnson, Denton, Parker, and Wise Counties, Texas, acting by and through its duly authorized Assistant City Manager (hereinafter referred to as "City"), and TARRANT COUNTY, Texas ("County"), collectively known as"the parties". RECITALS WHEREAS, on February 15, 2017 the City and County made and entered into an Interlocal Agreement (CSC No. 48675) ("Agreement") in accordance with Chapter 791 of the Texas Government Code for the purpose of limited rabies control under Chapter 826 of the Texas Health and Safety Code, also known as the Rabies Control Act of 1981; and WHEREAS, Section 3 of the Agreement provides that the Agreement will terminate on September 30, 2017 unless otherwise extended by mutual written agreement by the parties; and WHEREAS, County and the City wish to renew the Agreement for an additional one year term,unless extended as provided below; and NOW, THEREFORE, City and County acting herein and by and through their duly authorized representatives mutually agree to the following amendment of the Agreement: 1. Section 3. Term of the Agreement is deleted in its entirety and replaced with the following: 3. TERM Unless terminated pursuant to the terms herein, this Agreement shall be for a term of one year, beginning October 1, 2017 and ending on September 30, 2018. In addition, the term may be extended by mutual written agreement of the parties, for up to two (2) one-year terms. Impoundment and Disposition of Animals subsection A. of the Agreement is hereby amended to add "A" to the last sentence of the paragraph, to read as follows: 6. IMPOUNDMENT AND DISPOSITION OF ANIMALS A. A live, stray dog impounded by the City under this Agreement shall be held for a period of not less than seventy-two (72) hours, unless released earlier to its owner("Animal Owner"). A quarantined animal shall be held or presented for testing according to the Act and the Rules. The County shall provide in writing to the City the date of the bite incident and the animal's date of release from quarantine. Any dog presented by a resident of unincorporated Tarrant County may be accepted by the City provided that the County shall pay for such surrendered animals. 3. Section 9. Compensation of the Agreement is hereby amended to revise the total amount to be paid for the term of the Agreement, to provide that payment of the total amount is to be made in monthly payments,to read as follows: 9. COMPENSATION A. As fair compensation for the services rendered County agrees to pay City for its services a flat fee as provided in section B, below. City agrees to provide services for the term of this Agreement. B. County will not pay City more than $132,000 in total for the term of this agreement, for services rendered during the term of this Agreement unless agreed in writing by the Parties. This amount shall constitute payment for all services rendered by the City during the term of this Agreement. County shall pay City monthly an amount equal to $11,000.00 for the term of the Agreement. County and City agree such payments are to be made from current revenues available to County, within ten (10) days of the end of the month for which services are rendered or until such time the County implements an auto pay system upon which payment shall conform to such auto pay system. Until such time that an auto pay system is implemented by the County, City shall provide an invoice to the County for the monthly amount. Invoices shall be addressed to: Tarrant County Public Health Attn: Eileen, Hogan,Business Office 1101 S. Main Street Fort Worth, Texas 76104 C. Pursuant to the requirements of Section 791.01 l(d)(3) of the Texas Government Code, the amount due City under subparagraph A. above shall be paid from revenues available to County in that current fiscal year. 2017-2018 ILA-A with Tarrant County for Rabies Control Page 2 of 3 4. Except as amended by this Amendment, all of the terms and conditions of the Agreement, as amended, are ratified and remain in full force and effect. This Amendment shall be effective on , 2018.
