HomeMy WebLinkAboutContract 49554-A1 CITY SECRETARYL CONTRACT NO. *5) /" AMENDMENT No.1 c�Omc XV" TO CITY SECRETARY CONTRACT No. 49554 WHEREAS, the City of Fort Worth (CITY) and Kimley-Horn and Associates, Inc. , (ENGINEER) made and entered into City Secretary Contract No. 49554, (the CONTRACT) which was authorized by M&C C-28333 on the 15th day of August, 2017 in the amount of $ 199, 500. 00; and WHEREAS, the CONTRACT involves engineering services for the following project: Update of Water and Wastewater Installation Policy and Design Criteria; and WHEREAS, it has become necessary to execute Amendment No. 1 to the CONTRACT to include an increased scope of work and revised fee. NOW THEREFORE, CITY and ENGINEER, acting herein by and through their duly authorized representatives, enter into the following agreement, which amends the CONTRACT: 1. Article I of the CONTRACT is amended to include the additional engineering services specified in a proposal dated June 13, 2018, a copy of which is attached hereto and incorporated herein. The cost to City for the additional design services to be performed by Engineer totals $ 85, 000. 00. (See Attached Funding Breakdown Sheet, Page -3-) 2 . Article II of the CONTRACT is amended to provide for an increase in the fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall be an amount of $284, 500 . 00. 3. All other provisions of the Contract, which are not expressly amended herein, shall remain in full force and effect. EXECUTED and EFFECTIVE as of the date last written by a signatory, below. Water Planning, Strategic Developments and Asset Management Engineering Manager City of Fort Worth Water Department 200 Texas Fort Worth, TX 76012 RE: City of Fort Worth Water Department Water and Wastewater Installation Policy and Design Criteria Update City Secretary Contract#49554 Amendment#1-Additional Services Request Kimley-Horn No. 069018999 Dear Wendy: Throughout this project, there have been multiple items requiring additional services that were not previously identified in the original contract. We are requesting your consideration to amend our contract to allow for additional services related to additional City review meetings, Urban Infill and Shared Access Easements, and additional Development Advisory Committee (DAC)meetings. City Review Meetings The original contract included provisions for up to 2 meetings with the City to review each section. Due to the significant number of changes proposed and discussed in the Water,Wastewater, Policy, and Easement sections, multiple meetings, and subsequent revisions, have occurred for each of these sections. Urban Infill and Shared Access Easements The original contract included provisions for updating the easement requirements associated with the existing policy documents. Due to on-going DAC Urban Infill Sub-Committee meetings related to special easement requirements, Kimley-Horn developed multiple exhibits and attended various DAC sub-committee meetings with, and on behalf of,the Water Department to discuss easement requirements for easements within Urban Infill areas and Shared Access developments. These services were not included in the original scope of services. DAC Review Meetings The original contract included provisions for up to 3 meetings with the City to review revised sections of the updated documents with DAC. Due to the structure and detail associated with these meetings up to 8 meetings are anticipated. In addition, 2 presentations are anticipated to full DAC for approval. iii Ms. Wendy Chi-Babulal, P.E., June 13, 2018, Page 2 The additional amount requested for the outline additional services above is $85,000, and is summarized below.
