AMENDMENT No.4
TO CITY SECRETARY CONTRACT
WHEREAS, the City of Fort Worth (CITY) and
Visintainer Engineering, PLLC (ENGINEER) made and entered into
City Secretary Contract No. 45925, (the CONTRACT) which was
authorized by M&C C-26933, on the 26th day of August, 2014 in
the amount of $260,428. 00; and
WHEREAS, the CONTRACT was subsequently revised by
Amendment Number 1 in the amount $35,780 . 00 which was
administratively authorized on the 9th day of October, 2014
and Amendment No.2 in the amount of $39,808 . 00 which was
administratively authorized on the 6th day of January, 2015
and Amendment No.3 in the amount of $24,350 . 00 which was
administratively authorized on 9th day of June 2017; and
WHEREAS, the CONTRACT involves engineering services for the
following project:
Water and Sanitary Sewer Replacement Contract 2014, WSM-C; and
WHEREAS, it has become necessary to execute Amendment No. 4
to the CONTRACT to include an increased scope of work and
revised fee
NOW THEREFORE, CITY and ENGINEER, acting herein by and
through their duly authorized representatives, enter into the
following agreement, which amends the CONTRACT:

Article I of the CONTRACT is amended to include the additional
engineering services specified in a proposal dated May 23,
2018, a copy of which is attached hereto and incorporated
herein. The cost to City for the additional design services to
be performed by Engineer totals $65,025 .00 .
2 .
Article II of the CONTRACT is amended to provide for an
increase in the fee to be paid to Engineer for all work and
services performed under the Contract, as amended, so that the
total fee paid by the City for all work and services shall be
an amount of $425,391 .00 .

All other provisions of the Contract, which are not expressly
amended herein, shall remain in full force and effect.

Additional effort includes design of an additional sanitary sewer line on Oakwood Scenic Drive. Design

phase and construction phase services for same..

RECOMMENDATION:

1. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the
Water and Sewer Capital Fund in the amount of$85,000.00 from available funds; and
2. Authorize the execution ofAmendment No. 4inthe amount of$85.U25.UOtoCity Secretary

DISCUSSION:
On August 26, 2014, Mayor and Council Communication (M&C C-26933), the City Council authorized the
execution of an Engineering Agreement with Visintainer Engineering, PLLC, in the amount of$260,428.00
for the preparation of plans and specifications for the replacement of the water and/or sanitary sewer
mains onvarious streets aeidentified inthat [W&C. The Agreement was subsequently revised by
Amendment No. 1 in the amount of$35,780.00 administratively authorized October 9, 2014, Amendment
No. 2inthe amount of$39,808.00 administratively authorized January 6, 2015 and Amendment No. 3 in
the amount ny$24.3U5.UUadministratively authorized June 8. 2U17.
Amendment No. 4 will provide the necessary design for replacement of the existing severely deteriorated
sanitary sewer main located east of I.H. 35 between Yucca Avenue and Watauga Road.
In addition to the amendment amount, $19,975.00 is required for project management.

K8/VVBE OFFICE: Viaintainer Engineering, PLLC agrees to maintain its initial SBE commitment of33
percent that it made on the original agreement and extend and maintain that same SBE commitment of 33
percent to all prior amendments up to and inclusive ofthis Amendment No. 4. Therafore, Vieintainar
Engineering, PLLC remains in compliance with the City's BDE Ordinance and attests to its commitment by
its signature on the Acceptance of Previous SBE Commitment form executed by an authorized
representative ofits company.

The Director of Finance certifies that upon approval of the above recommendation and adoption of the
attached appropriation ordinance, funds will be available in the current capital budget, as appropriated, of
the Water and Sewer Capital Fund. The Fiscal Year 2018 Water Operating Budget includes
appropriations of$29,022,689.00 for the purpose of providing Pay-As-You-Go funding for Sewer Capital
Projects. After this transfer for Fiscal Year 2018, the balance will be $7,127,868.00.
