CITY OF FORT WORTH MEMORANDUM OF AGREEMENT
CiTYSFCRRrARY BETWEEN
THE OKLAHOMA ARMY NATIONAL GUARD AND THE LANDOWNER
SUBJECT: Land Use Agreement
1. This agreement made this 23rd day of April 2018,between The City of Fort Worth;TX.
(Landowner)and 631 Civil Support Team(WMD),a unit of the Oklahoma Army National Guard
(Guard).
2. The Landowner in consideration of the covenants and agreements hereinafter setforth does by these
presents grant to the Guard the non-exclusive right to use the following described property:Bob Bolen
Public safety Complex,505 W Felix St,Fort Worth,TX 76115.
3.. This agreement is for the period beginning 23 April 2018 and terminating on.23 April 2020. Said
agreement may be terminated by either party giving the other party ONE-DAY verbal or written notice.
4. It is understood that the Guard intends to use the property to conduct training. Said' aining shall
include simulated full scale Chemical,.Biological,Radiological,Nuclear/Hazardous.Materials
(CBRN/HAMAT)emergency response operations.Site characterization,hazard monitoring,hazard
material sampling,decontamination,and hazard analysis will be. performed.Personnel will.be wearing
personal protective equipment(PPE)that consists of full face mask and self-contained breathing
apparatus(SOBA)and an Occupational Safety and Health Administration(OSHA.)approved Level A
fully encapsulated.chemical protective Suit.Training will.also include emergency rescue operations.
Local Law Enforcement,Fire Dept.and emergency responders will train in conjunction with.63rd CST
personnel.Training will occur between 1 to 5 days each instance and between 0600 anA 1800. 63rd CST
will have 22 personnel,9 General Services Administration(GSA)vehicles consisting of 5-Ford F450
Trucks, 1-GM 3500 Ambulance:(NIRV,Not for hire);1-C6500 GM Analytical Vehicle, l-International
Dura Star 4400, 1-6x4 John Deere Gator;and 4 trailers consisting of 2-16'Box trailers,11-24"Box Trailer,
1-26'Command Trailer,The C6500 GM.Analytical Vehicle.functions as a mobile analytical laboratory
that contains a Gas Chromatograph/Mass Spectrometer(GC/MS)for chemical analysis:Handheld air
monitors,radiation meters,and chemical agent detectors will be in use.This location will be used once
quarterly to support 63rd CST training events.Hazardous materials used will be training simulants only,
and in small quantities so they do not pose any environmental or health concerns.Vehicles will not.travel
offroad,and no ground disturbance will occur.
5. Except as stated in this paragraph,it is understood that the Guard will not store or permit any other
persons to store on the property anything which would be detrimental to the property or'.a fire hazard or
which would endanger personnel or constitute a public nuisance.
Exceptions:N/A
6.Except as stated in this paragraph,it is understood that.the Guard at its own expense will remove or
cause to be removed all Guard property which it may have.placed on the Landowner's property.

7. Itis understood that the Guard will be responsible for the maintenance of order and safety in
connection with the use of Landowner's property.

8.Except as stated in this paragraph,it is understood that at the end of this agreement, or sooner
terminated thereof,the Guard shall give peaceable possession to the Landowner in the same condition as
the property was in at the time of execution of this agreement,the usual wear and tear by the training
described above and damage by the elements excepted.

9. THIS LICENSE MAY NOT BE ASSIGNED OR TRANSFERRED.
