WHEREAS, the City of Fort Worth (CITY) and 360 Clarus, LLC,
(ENGINEER) made and entered into City Secretary Contract No. 47570, (the
CONTRACT) which was authorized by M&C C-27633 on the 1St day of March,
2016 in the amount of $250, 000; and
WHEREAS, the CONTRACT involves engineering services for the
following project:
Hydraulic Modeling Assistance Contract; and
WHEREAS, it has become necessary to execute Amendment No. 1 to the
CONTRACT to include an increased scope of work and revised fee.
NOW THEREFORE, CITY and .ENGINEER, acting herein by and through their
duly authorized representatives, enter into the following agreement,
which amends the CONTRACT:

Article I of the CONTRACT is amended to include the additional
engineering services specified in a proposal dated July 16 2018, a copy
of which is attached hereto and incorporated herein. The cost to City
for the additional design services to be performed by Engineer totals
$150,000. (See Attached Funding Breakdown Sheet, Page -3-)

Article II of the CONTRACT is amended to provide for an increase in
the fee to be paid to Engineer for all work and services performed under
the Contract, as amended, so that the total fee paid by the City for all
work and services shall be an amount of $400,000.

Article III of the contract is amended to provide for an addition of time
to the term. The following statement shall control the expiration of this
agreement: Unless otherwise terminated pursuant to the terms of the
original Agreement, this agreement shall continue for an additional 24
months from the original effective date unless approved funds are
exhausted prior to that date.
All other provisions of the Contract, which are not expressly
amended herein, shall remain in full force and effect.

Mr. Konduru:
Per our recent discussions, it is our understanding that the City would like to amend the
current Hydraulic Modeling Assistance contract to continue the current work efforts. The
scope of services will remain the same as described in Attachment A of the existing
contract.
The additional costs to continue the efforts is anticipated to be $150,000. As discussed
in the existing scope of services, separate task orders will be issued to define the specific
scope of work for the additional efforts. Therefore, we respectfully request a contract
amendment in the amount of $150,000. With approval of this amendment, the total
amended contract amount would total $400,000.
We are available at your convenience to discuss the proposed contract amendment
should you have any questions. We appreciate the opportunity to work with you on this
important effort, and we are grateful that you consider us a partner in aiding on these
matters.

Authorize Execution of Amendment No. 1 to the Professional Services Agreement with 360

Additional Time for Hydraulic Modeling Assistance Contract(ALL COUNCIL DISTRICTS)
RECOMMENDATION:
It is recommended that the City Council authorize the execution of Amendment No. 1 to the
Professional Services Agreement with 360 Clarus, LLC, (City Secretary Contract No. 47570)
in an amount up to $150,000.00 and the addition of up to 24 months for Hydraulic Modeling
Assistance Contract.
DISCUSSION:
The purpose of this Mayor and Council Communication is to authorize Amendment No. 1 to
the Professional Services Agreement with 360 Clarus, LLC (M&C), for additional funding and
time to continue services to ensure the quality and consistency of drainage models produced
by engineering consultants working on City projects. The original agreement was approved by
City Council on March 1, 2016, (M&C C-27633) in the amount of$250,000.00 and had a 36
month completion timeframe. There are multiple drainage modeling projects ongoing and in
queue, thus,this addition of funds and extension of time is necessary.
Drainage modelling is a very specialized field that has seen rapid advancement in technology
and capability in the past 10 years and these models are often a vital part of the development
of affordable and effective solutions to flooding problems.
This amendment, in the amount of$150,000.00, is expected to provide for the review of
models produced over the next 24 months. Staff considers this fee to be fair and reasonable
for the services to be performed.
There is no anticipated annual operating cost to the Transportation and Public Works (TPW)
Stormwater Management Division.
M/WBE Office - The consultant, 360 Clarus, LLC, is in compliance with the City's BDE
Ordinance for the Amendment No. 1. A waiver of goal for MBE/SBE subcontracting
requirements was requested by the Department and approved by the M/WBE office, in
accordance with M/WBE or BDE ordinance,because the purchase of goods or services from
source(s) where subcontracting or supplier opportunities are negligible.
This stormwater contract area is located in ALL COUNCIL DISTRICTS.
FISCAL INFORMATION/ CERTIFICATION:
The Director of Finance certifies that upon approval of the above recommendation, funds will
available as appropriated in the Capital Budget of the Stormwater Capital Projects Fund. Prior
to an expenditure being incurred, the participating department has the responsibility to validate
the availability of funds.
