(Consultant) made and entered into City Secretary Contract No. (The Contract) which was authorized by the City Council by M&C C-28294, the 20th day of June, 2017, to provide architectural design and construction administration services for the New Como Community Center located at Chamberlin Park and; WHEREAS, further amendment is necessary to reimburse the Consultant as part of the design services for additional Civil design services, see Attachment "J". NOW THEREFORE, City and Consultant, acting herein by and through their duly authorized representatives, enter into the following agreement which amends the Contract: 1. Article I — Scope of Services, Paragraph (3) shall be added to read as follows: (3) Provide additional MEP design services for the design and detailing of additional concepts. The cost of this additional service is $8,160.00 plus $0.00 in reimbursable expenses. The scope of services is described more fully in HKS, Inc.'s Letter dated August 30, 2018 labeled Attachment "J". 2. Article II — Compensation, first paragraph, is amended as follows: "Consultant shall be compensated in accordance with the Fee Schedule shown in Attachment "A". Payment shall be considered full compensation for all labor, materials, supplies, and equipment necessary to complete the services described in Attachment "A". However the total fee paid by the City shall not exceed a total of $899,301.74 unless the City and the Consultant mutually agree upon a fee amount for additional services and amend this Agreement accordingly." 3. Dunaway will prepare exhibits for Parkland Conversions for the floodplain easement, drainage easement, AT&T line, ONCOR overhead electrical lines and Right-of-Way clips on the northwest and northeast corners of the property. Dunaway will address up to one round of comments from the City. Dunaway will attend up to two Park Advisory Board meetings and one City Council meeting for the Parkland Conversions. If additional meetings or exhibit revisions to address additional comments are necessary,the time required to prepare the exhibits or attend the meetings will be tracked and billed on an hourly basis and is not part of this proposed scope of work. It should also be noted that Dunaway cannot and does not guarantee that the request for parkland conversions will ultimately be approved by the Par Board and/or City Council. The fee requested is Eight Thousand One Hundred Sixty Dollars. ($8,160.00). Including the 2% administration fee.
