sFC99Y THIRD ADDENDUM TO CITY SECRETARY
CONTRACT NO. 50758
This Third Addendum to City Secretary Contract Number 50758 ("Agreement") is by and
between the City of Fort Worth ("City"), a home-rule municipality organized under the laws of
the State of Texas, acting by and through its duly authorized Assistant City Manager, and
Displays LLC, acting through Pamela Suggs, its Director of Operations (the "Contractor"). The
City has designated the Arts Council of Fort Worth and Tarrant County, Inc. as its Contract
Manager to manage this agreement on its behalf.
WHEREAS, on May 20, 2017, the City and Contractor entered into City Secretary
Contract ("CSC") Number 50758 (CSC No. 50758), whereby Contractor agreed to provide
specific services for the purpose of assisting with the care and maintenance of the Public Art
Collection, one Renewal (CSC No. 50758-R2), one Amendment (CSC 50758-A I AD2), and two
Addenda(CSC 50758-AD l and CSC 50758-A I AD2);
WHEREAS, the City is in need of services as specified in this Third Addendum
(collectively "Services");
WHEREAS, City owns and maintains a public Artwork titled Freedom Train
("Artwork") by Jeff Gottfried ("Artist") which is sited in the T&P Station lobby located at 221
W. Lancaster, 76102("Site");
WHEREAS, the Artwork is an installation comprised of cut stainless steel images
depicting figures working and traveling on a train which is attached by brackets to a support
wall, a picture of Artwork is attached hereto as Exhibit"G;"
WHEREAS, an element of the Artwork was vandalized by an unknown source bending
an element depicting a hammer and the Artwork was removed on September 26, 2018, to the
Contractor's facility in order to protect the Artwork from further damage;
WHEREAS, Contractor has provide an estimate to repair, refinish, and reinstall the
Artwork,as necessary,which is attached hereto as Exhibit"H;"and
WHEREAS, the City and Contractor wish to set out the Services to be provided per the
Agreement that will be specific to this Third Addendum with the intent that further Services may
be requested by the City through future addenda;
NOW, THEREFORE, in consideration of the mutual covenants and agreements
hereinafter set forth, the sufficiency of which is hereby acknowledged, the parties agree as
follows:

Contractor hereby agrees to provide the City with professional services for repairs to the
Artwork, as outlined in Exhibit"H,"Contractor's Estimate, which is attached hereto and
incorporated within as if copied in full.

Contractor shall notify City, through its Contract Manager, prior to refinishing the
Artwork to advise whether only repairs are sufficient. Contractor shall proceed with refinishing
at City's request only. Contractor shall notify City, through its Contract Manager, in writing
when the repairs and refinishing, if authorized by City, are complete and ready for delivery and
installation at the Site.

All terms and conditions of the Agreement not specifically addressed herein remain in
full force and effect and are binding upon the parties.
