Re: Notice of Termination of Lease Under City Secretary Contract 50585
Mr. Fink,
This Notice of Termination of Lease is sent in accordance with Section 17 of Fort Worth City
Secretary Contract No. 50585.
At present the City of Fort Worth (the "City") and TAP Holdings are parties to City
Secretary Contract(CSC) 50585, a lease agreement for use of certain designated space at Fort Worth
Meacham International Airport (the "Lease"). Pursuant to Section 4.1.1 of the Lease, the Lessee
was required to commence construction of the designated space described in the lease within six (6)
months following the execution of CSC-50585. The City has determined that over six months has
passed since the execution of CSC-50585 and construction has not begun on the Leased Premises.
Therefore, under Section 17 of the Lease (Termination), "all rights, powers and privileges
granted to Lessee hereunder shall cease and Lessee shall immediately vacate the Premises." Per
Section 18 of the Lease, notice is "deemed to have been received when (1) hand delivered to the
other party, its agents, employees, servants or representatives, or (2) deposited in the United States
mail, postage prepaid." The City is hereby notifying you of its intent to terminate City
Secretary Contract 50585, effective immediately from the date of this letter, which is the same
as the date of mailing.
