Notice for Establishment of a Railroad Quiet Zone under 49 CFR 222.39 and 49 CFR 222.59 and under Appendix A and E to Part 222. This letter and the attachments are a Notice of Establishment(NOE)for the creation of a quiet zone under 49 CFR 222.39(a)(3),49 CFR 22.59, Appendix A to Part 222.A.3(b)and Appendix E to Part 222.E(1-6). As required by the Federal Railroad Administration under 49 CFR 222.43, the following information is provided to you and other parties. EFFECTIVE DATE OF QUIET ZONE -222.43(d)(1)(i) Routine use of the locomotive horn at the crossings listed below shall cease effective November 24, 2018. The City has installed non-mountable concrete medians at this crossing approximately 80 feet in length to the north of the crossing and approximately 70 feet in length to the south, reducing the traffic lanes over the crossing to two lanes. The improvements do not qualify as a SSM due to a driveway located less than sixty feet from the crossing. The City does not take credit for this modified SSM in the quiet zone calculations(see Attachment E).The existing lights and bells will provide pedestrians warning of the approaching train and the diagnostic team had no additional recommendations for pedestrian treatments. Winnie Street—SSM Closure Winnie Street is an existing two-lane highway equipped with flashing lights and gates, constant warning circuitry, and power-out indicators.The City has permanently closed this crossing by removing pavement and installing Type III barricades to prevent access to railroad right-of-way. All traffic from this location will be diverted to the South Tierney Road crossing. SSM credit will be taken for this improvement in the quiet zone calculations (see Attachment E). South Tierney Road—Non-SSM Concrete Median South Tierney Road is an existing two-lane highway equipped with flashing lights and gates, constant warning circuitry, and power-out indicators.The City has installed non-mountable concrete medians at this crossing approximately 35 feet in length to the north of the crossing and approximately 100 feet in length to the south of the crossing.The improvements do not qualify as a SSM due to a parallel street located less than sixty feet from the crossing. The City does not take credit for this modified SSM in the quiet zone calculations (see Attachment E). The City has installed approximately 50 feet of channelization/concrete median (or buttons)along the parallel street(Old Handley Road)as recommended by the diagnostic team. The City has also installed new sidewalk along the west side of the crossing to provide improved pedestrian movement as recommended by the diagnostic team, as well as additional concrete panels to facilitate the pedestrian crossing. The existing lights and bells will provide pedestrians warning of the approaching train and the diagnostic team had no additional recommendations for pedestrian treatments. South Hughes Avenue— Non-SSM Concrete Median South Hughes Avenue is an existing two-lane highway equipped with flashing lights and gates, constant warning circuitry, and power-out indicators.The City has installed non-mountable concrete medians at this crossing approximately 70 feet in length to the north of the crossing and approximately 32 feet in length to the south of the crossing. The improvements do not qualify as a SSM due to private driveways located less than 100 feet from the crossing on both approaches.The City does not take credit for this modified SSM in the quiet zone calculations (see Attachment E). The existing lights and bells will provide pedestrians warning of the approaching train and the diagnostic team had no additional recommendations for pedestrian treatments. Miller/Oakland Avenue—SSM Concrete Median Miller/Oakland Avenue is an existing divided four-lane highway equipped with flashing lights and gates, constant warning circuitry, and power-out indicators. The City has installed non-mountable concrete medians at this crossing a minimum of 100 feet in length to the north of the crossing and a minimum of 60 feet in length to the south of the crossing. SSM credit will be taken for these improvements in the quiet zone calculations (see Attachment Q. The existing lights and bells will provide pedestrians warning of the approaching train and the diagnostic team had no additional recommendations for pedestrian treatments. South Ayers Avenue—SSM Concrete Median South Ayers Avenue is an existing two-lane highway equipped with flashing lights and gates, constant warning circuitry, and power-out indicators.The City has installed non-mountable concrete medians at this crossing that will be a minimum of 100 feet in length to the north and approximately 70 feet in length to the south of the crossing. SSM credit will be taken for these improvements in the quiet zone calculations (see Attachment E). The existing lights and bells will provide pedestrians warning of the approaching train and the diagnostic team had no additional recommendations for pedestrian treatments. REGULATORY BASIS FOR QUIET ZONE ESTABLISHMENT—222.43(d)(2)(ii) This quiet zone is being established under 49 CFR 222.39(a)(3), 49 CFR 222.59, Appendix A to Part 222.A.3(b)and Appendix E to Part 222.E(1-6). FRA quiet zone calculations can be found in Attachment E. DIAGNOSTIC TEAM REVIEW-222.43(d)(2)(iii) A diagnostic team review is not required for this quiet zone under 222.39(b) or 222.27. However, the agency did invite State agency representatives, all affected railroads, and the FRA to attend a diagnostic team review that was conducted on June 23, 2015. TIME PERIOD FOR HORN RESTRICTION -222.43(d)(2)(iv) The quiet zone is proposed to restrict the routine sounding of locomotive horns 24 hours a day. EXISTING GRADE CROSSING INVENTORY FORMS - 222.43(d)(2)(v) Accurate and complete grade crossing inventory forms for each public, private, and pedestrian grade crossing within the quiet zone that reflects conditions existing at the crossings before quiet zone improvements were made are provided in Attachment C. QUIET ZONE GRADE CROSSING INVENTORY FORMS -222.43(d)(2)(vi) Accurate and complete grade crossing inventory forms for each public, private, and pedestrian grade crossing with in the quiet zone that reflects SSMs in place upon establishment of the quiet zone are provided in Attachment D. DISCUSSION: The Transportation and Public Works Department proposes to create quiet zones,which will allow trains to proceed through street crossings without sounding their horns thereby reducing noise levels in the surrounding residential areas.
