TEXAS DEPARTMENT OF TRANSPORTATION AIRPORT PROJECT PARTICIPATION AGREEMENT (Federally Assisted Airport Development) TxDOT CSJ No.: 0602SPINK TxDOT Project No.: AP SPINKS 8 TxDOT Contract No. : 6XXAV071 Commission Approval: December 15, 2005 Amendment No. 01 to the Agreement Part I -Identification of the Project TO: The City of Fort Worth, Texas FROM: The State of Texas, acting through the Texas Department of Transportation The City of Fort Worth, Texas, hereinafter referred to as the "Sponsor," and the Texas Department of Transportation, hereinafter referred to as the "State," have entered into an Airport Project Participation Agreement TxDOT CSJ Number 0602SPINK, executed by the Sponsor on March 13, 2006, and by the State on March 20, 2006, for the development of the Fort Worth Spinks Airport, hereinafter referred to as the "Airport". The project is described as engineering/design services to: reconstruct portion of taxiway C; reconstruct taxiway T-2 with drainage culvert; construct taxiway T-3 with drainage culvert; and install culvert on Wildcat Way North road and reconstruct portion of road at the Fort Worth Spinks Airport. It is in the mutual interest of the Sponsor and the State to increase the agreement by $52,000 for the negotiated engineering fee. Part II - Offer of Financial Assistance, estimates total project costs to be $130,000; and financial assistance is currently limited to $117,000 in federal funds and $13,000 in local sponsor funds. The following amendment to the Airport Project Participation Agreement shall become effective upon execution of this Amendment by the Sponsor and the State. The Airport Project Participation Agreement is amended as follows: 1. On Part II, Item No. 2 of the Agreement, change Amount A, estimated total design costs, and any further references in the Agreement to Amount A, to $182,000. Page 1 of 3 2. On Part II, Item No. 2 of the Agreement, change Amount B, estimated design costs eligible for federal financial assistance, and any further references in the Agreement to Amount B, to $182,000. $154,880 is eligible for 90% federal and 10% local funding and $27,120 is eligible for 50% federal and 50% local funding. 3. On Part II, Item 3 of the Agreement, change Amount D, the maximum obligation of the United States payable under this offer, and any further references in the Agreement to Amount D, to $152,952. 4. On Part H, Item 4 of the Agreement, change Amount E, Sponsor's share of the estimated design costs, and any further references in the Agreement to Amount E, to $29,048. All other terms and conditions of the agreement are unchanged and remain in full force and effect. This Amendment to the Airport Project Participation Agreement between the City of Fort Worth, Texas, and the Texas Department of Transportation is mutually agreed to and accepted. Accept a grant from the Texas Department of Transportation (TxDOT) in the amount of$1,180,000.00 to install a culvert and reconstruct a portion of Wildcat Way North and improve eastside taxiways at Fort Worth Spinks Airport; 2. Adopt the attached resolution certifying that $258,000.00 in City funds will be available for the match of the total project costs ($83,000 at a 10% match and $175,000 at a 50% match); 3. Authorize the transfer of funds in the amount of $83,000.00 from the Aviation Improvements Capital Projects Fund to the Airport Grants Fund for the 10% match; 4. Authorize the transfer of funds in the amount of $175,000.00 from the Critical Capital Projects Fund to the Airport Grants Fund for the 50% match; and 5. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Airport Grants Fund by $1,180,000.00, subject to receipt of the grant. DISCUSSION: This project will fund road and taxiway improvements at Spinks Airport that will result in increased aircraft traffic on the northeast side of the airport. Due to recent corporate and general aviation hangar developments, the project entails the reconstruction of portions of Taxiway C, Taxiway T-2 and Taxiway T-3 on the northeast side of the airport and the engineering, design and reconstruction of Wildcat Way North, the north airport entrance road. To repair current drainage deficiencies, the project also includes new drainage culverts under the taxiways and entrance road to divert water under the taxiways. The engineering and design for this project will be completed in fiscal year 2006 and construction will occur in fiscal year 2007.
