WHEREAS, the City of Fort Worth ("City") and Freese & Nichols, Inc. ("Consultant")
made and entered into City of Fort Worth City Secretary Contract No. 30187, ("Contract") which
was authorized by the City Council by M&C C-20145 on July 6, 2004; and
WHEREAS,the Contract involves professional services for the following project:
Fort Worth Water Gardens—Re-design of the Grove Area Lighting and Paving
WHEREAS, it has become necessary to amend the Contract to include an increased scope
of work and/or revised maximum fee.
NOW, THEREFORE, City and Consultant, acting herein by and through their
duly authorized representatives, enter into the following agreement which amends the contract:
1.
Article I, Section A of the Contract is amended to include the additional engineering
services identified on Attachment B-4, dated April 23, 2006, a copy of which is attached hereto
and incorporated herein.
2.
Article H of the Contract is amended to provide for an increase in the maximum fee in
the amount of $ 9,017.00, which is to be paid to Consultant for all work and services under the
Contract, as amended, so that the total fee to be paid by City for all work and services shall not
exceed the sum of $ 558,412.
3.
All other provisions of the Contract that are not expressly amended herein shall remain in
full force and effect.

AMENDMENT 44 TO
AGREEMENT FOR ENGINEERING SERVICES
BETWEEN
THE CITY OF FORT WORTH AND FREESE AND NICHOLS,INC. FOR
OPERATIONAL ASSESSMENT AND ALTERNATIVE EVALUATIONS FOR
THE ACTIVE POOL AREA OF THE FORT WORTH WATER GARDENS
ADDITIONAL SERVICES
FOR
DESIGN OF STRUCTURAL AND LIGHTING MODIFICATIONS
AT THE GROVE AREA
SECTION 1 —INTRODUCTION
This amendment is for additional services related the detailed design of modifications to the concrete
paving and lighting at the Grove area of the Water Gardens. The original improvement plans
prepared by Freese and Nichols planned to install flush mounted lighting fixtures in the tree wells.
However,the project team has determined that the existing tree wells are too close together,and are
too small to provide a good growing environment for the trees,and has recommended that the trees
be removed and replaced. Freese and Nichols recommends that the concrete paving be completely
removed and replaced with the tree wells properly sized and spaced,the existing subgrade removed
and replaced with an engineered soil mix better suited for tree planting,and light fixtures placed in
the concrete rather than within the tree wells.
SECTION 2—ADDITIONAL SERVICES
This section describes the additional services FNI will provide relative to the design of the
modifications to the paving and lighting of the Grove Area.
1.0 DETAILED DESIGN OF PAVING AND LIGHTING AT GROVE AREA
1. Coordination with architectural consultant and City staff.
2. Structural design plans, sections and details for the paving at the Grove Area.
3. Electrical design,plans, sections and details for the lighting at the Grove Area.
4. Construction technical specifications.
