Home My WebLink AboutContract 33869-A2 AMENDMENT NO. 2 STATE OF TEXAS 8 CITY SECR.ETARYONTRACT NO.3MO_ (M&C Required) COUNTY OF TARRANT b WHEREAS, the City of Fort Worth (City) and ARS Engineers, Inc. , (Engineer) made and entered into City Secretary Contract No. 33869, (the Contract) which was authorized by the City Council by M&C C-21553 on the 11th day of July, 2006 and; subsequently revised by one previous amendment; and WHEREAS, the Contract involves engineering services for the following project: Water and Sanitary Sewer Replacement Contract 2005 WSM-H. WHEREAS, it has become necessary to execute Amendment No. 2 to said Contract to include an increased scope of work and revised maximum fee; NOW THEREFORE, City and Engineer, acting herein by and through their duly authorized representatives, enter into the following agreement which amends the Contract: 1 . Article I, of the Contract is amended to include the addition- al engineering services specified in M&C C-23313, adopted by the City Council on the 3th day of February, 2009 and further amplified in a proposal letter dated November 24, 2008, copies of which are both attached hereto and incorporated herein. The cost to City for the additional services to be performed by Engineer total $27,668.50. 2 . Article II, of the Contract is amended to provide for an increase in the maximum fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall not exceed the sum of $189,318.77. Authorize the transfer of$27,668.50 from the Water and Sewer Operating Fund to the Water Capital Projects Fund in the amount of$16,490.66 and Sewer Capital Projects Fund in the amount c $11,177.84; 2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in th Water Capital Projects Fund in the amount of$16,490.66 and the Sewer Capital Projects Fund in the amount of$11,177.84 from available funds; and 3. Authorize the City Manager to execute Amendment No. 2 in the amount of$27,668.50 to City Secretary Contract No. 33869 with ARS Engineers, Inc., for additional engineering services thereby increasing the contract amount to $189,318.77. DISCUSSION: On July 11, 2006, (M&C C-21553) the City Council authorized the City Manager to execute an engineering agreement with ARS Engineers, Inc., in the amount of$151,882.00 for Water and Sanitary Sewer Replacement Contract, 2005 WSM-H. The agreement was subsequently revised by one amendment (administratively approved by the City Manager on January 13, 2008), in the amount of$9,768.27 that provided for revisions to the project plans as requested by City staff and also provided for coordination with the consultant of an adjacent project. Amendment No. 2 will provide additional engineering services for the rehabilitation of sanitary sewer lateral L-5167 to improve the level of sewer service to residents in the area located between Kemble Street from Montclair Drive to Dead End. In addition, design will be provided for the replacement of the severely deteriorated water main located on the street. ARS Engineers, Inc., proposes to perform the necessary additional design work for a lump sum fee c $27,668.50. City of Fort Worth 1000 Throckmorton Sreet Fort Worth, TX 76102 RE: Engineering Agreement—Amendment No. 2 Water and Sanitary Sewer Replacement, Contract 2005, WSM-H Project No. P253-608170038430 & P258-708170038430 City Secretary Contract No. 33869 DOE No. 5294 ARS Project No. 30106005 Dear Mr. Sholola: This is a request for an amendment to the above referenced contract originally awarded on August 21, 2006. This amendment includes revisions of plans and specifications to separate Lynnhaven Road sanitary sewer and water line drawings from this project. Additional coordination is required to include Lynnhaven Road drawings with another project designed by another consultant. Also, included is the design of an 8-inch water line along Kemble Street between Montclair Drive and the dead end cul-de-sac of Kemble Street, and design of 610 linear feet of 8-inch sanitary sewer line between Montclair Drive and Shilling Drive(L-5167, Sta. 0+00 to Sta.6+10). The approved project budget for the original scope of work was a lump sum fee of$151,881.00. Amendment no. 1 was approved by the City in the amount of $ 9,768.27 on Jan.17, 2008 to include Weiler Boulevard drawings with another project being designed by another consultant. Now in Amendment No. 2, in accordance with the attached spreadsheet, we are proposing to the City approval of an additional lump sum engineering fee of $19,159.00 (water fee of $11,419.00, sewer fee of $7,740.00); and additional surveying fee of $8,509.50 (water survey fee of $5071.66, sewer survey fee of $3,437.84) making the total amendment amount of $27,668.50; and the total project compensation a lump sum fee of $189,337.77. This amendment of $27,668.50 will enable us to complete the necessary project revisions as stated herewith.
