SECOND AMENDMENT TO CITY SECRETARY
CONTRACT NO.34031
WHEREAS, on September 25, 2006, the City of Fort Worth ("City") and Connie
Arismendi ("Artist") made and entered into City Secretary Contract No. 34031 (the "Contract")
as authorized by City Council (M&C C-21328) and the City designated the Arts Council of Fort
Worth and Tarrant County,Inc. as its Contract Manager;
WHEREAS, on September 24, 2007, the City of Fort Worth ("City") and Connie Arismendi
("Artist") amended Contract No. 34031 by City Secretary Contract No. 35810 (the "Contract
Amendment"), recommending the use of the light product Color Kinetics iColor Flex SLX for
use in place of i-Light Plexineon and authorized an increase of ELEVEN THOUSAND ONE
HUNDRED NINETY FIVE DOLLARS AND NO CENTS ($11,195) in the contract amount.
The City designated the Arts Council of Fort Worth and Tarrant County, Inc. as its Contract
Manager;
WHEREAS, under the Contract, Artist shall design, fabricate, deliver and consult on the
installation of a light sculpture, described as five or more rings of light fabricated in Color
Kinetics iColor Flex SLX, or equal product, ranging from approximately 12' to 50' diameter
installed on the upper 180' of the 480' tower(the "Work")for the Rolling Hills Radio Tower;
WHEREAS, additional technical support from the Artist's lighting subcontractor is
anticipated during construction;
WHEREAS, the City has authorized an increase of up to SEVEN THOUSAND FIVE
HUNDRED DOLLARS AND NO CENTS ($7,500) in the contract amount to cover additional
costs; and

WHEREAS, the Long Range Public Art Plan for the Water Fund, adopted by City
Council in May 2006, authorizes the use of funds from the Public Art Fund to augment the
budget for bond-funded projects that require additional funds to fully implement.
NOW, THEREFORE, City, whose address is 1000 Throckmorton Street, Fort Worth,
Texas 76102,acting by and through Fernando Costa,its duly authorized Assistant City Manager,
and Connie Arismendi, whose address is 4009 Rosedale Avenue, Austin, Texas 78756, do
hereby agree as follows:

Article 2 Compensation and Payment Schedule This section is amended to add:
"2.4 Notwithstanding anything herein to the contrary, an amount up to SEVEN THOUSAND
FIVE HUNDRED DOLLARS AND NO CENTS ($7,500) shall be reimbursed to the Artist for
additional technical support from the Artist's lighting subcontractor during construction. Such
reimbursement shall be made within a reasonable time upon receipt of an invoice from the Artist
with the original invoice for such services attached."
All other terms and conditions of City Secretary Contract No. 34031 and 35810 and not
amended herein remain unaffected and in full force and effect, are binding upon the parties, and
are hereby ratified by the parties.
