(Engineer) made and entered into City Secretary Contract No. 34081 (the Contract) which was authorized by the City Council by M&C C-21725 on the 26th day of September 2006; and WHEREAS, the Contract involves engineering services for the following project: Pavement Reconstruction and Water and Sanitary Sewer Replacement on Westcreek Drive (Medina Avenue to Bilglade Road and Bilglade Road to Westfield Avenue) 2004 CIP Contract 44 Project No. 00444, DOE No. 5407 WHEREAS, it has become necessary to execute Amendment No. 3 to said Contract to include an increased scope of work and revised maximum fee; NOW THEREFORE, City and Engineer, acting herein by and through their duly-authorized representatives, enter into the following agreement which amends the Contract: 1. Article I of the Contract is amended to include the additional engineering services as specified in a proposal letter dated November 12, 2009, a copy of which is attached hereto and incorporated herein. The cost to City for the additional services to be performed by Engineer total $6,140.00. 2. Article II of the Contract is amended to provide for an increase in the maximum fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall not exceed the sum of $215,802.75. Consultants has been requested to provide additional engineering design services for the above referenced project. During construction two large trees located along Westcreek Drive at the svutheast corner of Westcreek and Bilglade Road were removed. Removal of the two trees has resulted in the possibility of destabilizing the existing landscape timber retaining wall and adjacent slope. The City has requested A.N.A. Consultants provide a retaining wall design to correct this potential hazard for the property located at 3509 Bilglade Road. In addltlon, the City has requested assistance flling the TCEQ required Storm Water Permit for the above referenced project. This request for additional services is not part of our existing contract and will exceed our current scope. A.N.A. Consultants, L.L.C. is recommending that our current contract be amended to include the additional services as well as the corresponding fee adjustments. DISCUSSION: The 2004 Capital Improvement Program (CIP) includes funds for pavement reconstruction on Westcreek Drive (Medina Avenue to Bilglade Avenue and Bilglade Road to Westfield Avenue). This project consists of the preparation of plans and specifications for the replacement of water and sanitary sewer mains and pavement reconstruction on the above identified streets. ANA Consultants, L.L.C., proposes to perform the necessary design work for a lump sum fee of $177,975.00. City staff considers this fee to be fair and reasonable for the scope of services proposed. In addition to the contract amount $41,115.51 (water: $6,360.76; sewer: $7,952.18; and streets: $26,802.57) is required for project management by the Engineering Department. ANA Consultants, L.L.C., is in compliance with the City's M/WBE Ordinance by committing to 22% M/V1/BE participation. The City's goal on the project is 22%.
