(No M&C Needed) COUNTY OF TARRANT § WHEREAS, the City of Fort Worth ("City") and AMEC Earth and Environmental, Inc. ("Engineer") made and entered into City Secretary Contract No. 30743 (the "Contract") which was authorized by the City Council by M& C C-20292 on September 21, 2004; WHEREAS,the Contract involves engineering services for the following project: Comprehensive Storm Water Management Study WHEREAS, the City Council authorized additional funding for said Contract in the amount of$ 740,000.00for Phase II Services, by M & C C-20666, which increased the maximum funding for all work and services to $1,037,348.00; WHEREAS, Amendment No. 1 to said Contract was executed in the amount of $695,024.00 for Phase 11 Services as shown in Updated Exhibit A-1; WHEREAS, it has become necessary to execute Amendment No. 2 to said Contract to include an increased scope of work and revised maximum fee; NOW THEREFORE, City and Engineer, acting herein by and through their duly authorized representatives, enter into the following agreement that amends the Contract: 1. Article I of the Contract is amended to include the additional engineering services specified in the proposal letter dated August 17, 2006, a copy of which is attached hereto and incorporated herein. The cost to the City for the additional design services to be performed by Engineer total $40,600.00. 2. rr Article II of the Contract is amended to provide for an increase in the maxiniuin fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall not exceed the sum of$1,037,348.00. 1')9 :29-06'C' , 3. A.N.A. Consultants will assist the City of Fort Worth with the implementation of the City's new Storm Water Utility. This assistance will be provided on an as needed basis and will consist of: 1. Analyzing,evaluating,and providing recommendations for fee exemptions related to runoff which flows to waterbodies not controlled or maintained by the city. In some cases this will require an analysis of complex drainage systems where drainage areas on-site must be allocated between exempt and non- exempt waterbodies,where a portion of the runoff flows to a waterbody not controlled or maintained by the City, in accordance with the City's exemption policy, 2. Providing independent and detailed analysis of impervious cover calculations as needed. Typically,these situations will involve appeals by customers involving identification or measurement of qualified impervious cover, Schedule: A.N.A.Consultants,L.L.C.will work"on-call"on an as needed basis with a targeted completion date of October 31,2006. These services will include using our subcontractor, A.N.A. Consultants, LLC, to provide drainage area calculations and survey support, as detailed on the attached letter agreement, as well as additional support from AMEC staff to manage this subcontractor work and assist with any final implementation issues. The requested contract amendment is in the amount of$40,600.00. Please let me know if you need additional information related to this contract modification.
