INTERLOCAL COOPERATION AGREEMENT FOR DETENTION SERVICES
BETWEEN
THE CITY OF FORT WORTH
AND
THE CITY OF MANSFIELD
THIS Amendment is made by and between the City of Fort Worth, Texas ("Fort Worth"),
acting herein by and through Charles W. Daniels, its duly authorized Assistant City Manager,
and the City of Mansfield ("Mansfield"), acting by and through Clay Chandler, its duly
authorized City Manager.
WHEREAS, Fort Worth and Mansfield entered into an Interlocal Cooperation
Agreement for Detention Services, an Agreement identified as City Secretary Contract No.
33979, for a period beginning October 1, 2006 and ending September 30, 2007, with subsequent
automatic renewals for nine one-year periods; and
WHEREAS, it is the mutual desire of the parties to amend Section 2.1 "Term."
NOW THEREFORE, KNOW ALL BY THESE PRESENT:

City Secretary Contract No. 33979, currently on file in the office of the City Secretary of
the City of Fort Worth and with the City of Mansfield, is hereby amended as follows.

Section 2.1, entitled"Term" is amended to read as follows:
Term. This Agreement shall be for an initial term ("Initial Term") of one year,
commencing on October 1, 2006 and ending on September 30, 2007. This
Agreement shall automatically annually renew for subsequent terms, commencing
October 1 of each year and ending on September 30 of each year for nine (9)
years after the Initial Term until September 30, 2016 ("Subsequent Terms"),
subject to the terms and conditions set forth herein, unless either party notifies the
other in writing one-hundred and eighty (180) days before any annual renewal
date of this Agreement of such party's election not to renew or extend this
Agreement.

All other terms, provisions, conditions, covenants and recitals of said City Secretary
Contract No. 33979, as amended by Fort Worth City Secretary Contract No. 33979-A1, which
are not expressly amended herein shall remain in full force and effect during the term this
renewal.

This Amendment is intended to take effect as of the date that it has been executed by authorized
representatives of both cities.

Authorize an Amendment to City Secretary Contract No. 33979 with the City of Mansfield for Detention
Services
RECOMMENDATION:
It is recommended that the City Council authorize an Amendment to City Secretary Contract No. 33979
with the City of Mansfield for detention services.
DISCUSSION:
The City of Mansfield currently provides detention services, including booking, transferring and detention
of prisoners arrested by the City of Fort Worth. The current contract with the City of Mansfield expires on
September 30, 2011, but automatically renews for five more one-year terms unless action is taken. An
Amendment has been negotiated that will increase the amount of notice required prior to either party
terminating the Agreement from three months to six months. All other terms and conditions will remain in
effect during this renewal.
FISCAL INFORMATION /CERTIFICATION:
The Financial Management Services Director certifies that this action will have no material effect on City
funds.
