WHEREAS, the City of Fort Worth (City) and D.R. Moss Land Development
Company, (Developer) entered into Community Facility Agreement, City Secretary
Contract No. 34434 wherein Developer is to make certain improvements to Willow
Sprinqs Ranch, within the City; and
WHEREAS, it has become necessary to execute Amendment No. 1 to the CFA
to reflect the variances unanimously approved by the Construction Fire and Prevention
Board of Appeals on March 8, 2007.
NOW THEREFORE, City and Developer, acting herein by and through their duly
authorized representatives, enter into the following agreement, which amends the CFA:
1.
Section II (B) Phase Three — Occupancy of the structures is amended to be and read:
• No structure on any lot (excluding lots permitted prior to July 1, 2006 for vertical
construction and lots for which the City of Fort Worth Construction and Fire Prevention
Board of Appeals approved a variance on March 8, 2007) shall be occupied until final
inspections have been completed, the structure released for occupancy by the City's
Development Department and the improvements required under this Agreement have
been constructed and accepted by the City.
2.
All other provisions of the CFA, which are not expressly amended herein, shall
remain in full force and effect.
