FIRST AMENDMENT TO CITY SECRETARY
CONTRACT NO. 33535
THIS First Amendment is entered into by and between the City of Fort Worth
("City"), a home-rule municipality in the State of Texas, acting through Joe Paniagua,
its duly authorized Assistant City Manager, and The Hai-ral Group, an agency doing
business in Texas ("Consultant"), by and through Harriet Harral, its duly authorized
principal.
WHEREAS, the City and Consultant, have entered into that certain agreement
identified as City Secretary Contract No. 33535 for a term of one year commencing on
May 16, 2006 for consulting services to evaluate the effectiveness of the City's
Smolcing Ordinance and to facilitate the City's Smoking Task Force; and
WHEREAS, the City Council has directed staff to conduct public hearings through
out the City to consider citizen concerns and recommendations;
WHEREAS, the services offered by Consultant will help to facilitate the City
Council's desire; and
WHEREAS, it is the mutual desire of the parties to amend said City Secretary
Contract No. 33535 for the expansion of the Scope of Work and compensation for
those duties, with all conditions, terms and pricing remaining the same as stated in
Contract No. 33535.
NOW, THEREFORE, THIS CONTRACT FURTHER WITNESSETH:
1. Section 1. Scope of Work and Exhibit A.
Section 1. The Scope of Work and Exhibit A shall be amended to include the following
duties and tasks by the Consultant:
A. Facilitation of four Public Hearings (as designated by the City) to include:

1. A plan for each hearing, which shall be approved by the City prior to each
hearing;
2. Management of the process as approved and directed by the City;
3. Convening and facilitation of each hearing;
4. A summaiy report submitted to the City after each hearing; and
5. Development of a presentation to the City Council (at such time as requested
by the City).
B. Presentation of a report of the findings and conclusions of the four public hearings to
City Council (at such time as requested by the City).
Section 2. Compensation.
Section 2. Compensation shall be amended as follows:
The amount to be paid to Consultant for all services performed under this First
Amendment shall not exceed four thousand dollars ($4,000) and shall include any
and all expenses incurred by Consultant. Consultant shall submit request for payment
pursuant to the City's rules and regulations.
All other terms and conditions of City Secretary Contract No. 33535 remain in full
force and effect.
