CL �G ItoAMENDMENT No.2 ` pF��GPti�P TO CITY SECRETARY CONTRACT No. 49554 WHEREAS, the City of Fort Worth (CITY) and Kimley-Horn and Associates, Inc. , (ENGINEER) made and entered into City Secretary Contract No. 49544, (the CONTRACT) which was authorized M&C C-28333 on the 15th day of August 2017 in the amount of $ 199, 500. 00; and WHEREAS, the CONTRACT was subsequently revised by: Amendment Number 1 in the amount of $85, 000 which was administratively authorized on July 9, 2018, WHEREAS, the CONTRACT involves engineering services for the following project: Update of Water and Wastewater Installation policy and Design Criteria; and WHEREAS, it has become necessary to execute Amendment No. 2 to the CONTRACT to include an increased scope of work and revised fee. NOW THEREFORE, CITY and ENGINEER, acting herein by and through their duly authorized representatives, enter into the following agreement, which amends the CONTRACT: 1. Article I of the CONTRACT is amended to include the additional engineering services specified in a proposal dated October 10, 2018, a copy of which is attached hereto and incorporated herein. The cost to City for the additional design services to be performed by Engineer totals $30,000. (See Attached Funding Breakdown Sheet, Page -3-) 2. Article II of the CONTRACT is amended to provide for an increase in the fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall be an amount of $314,500. 3. All other provisions of the Contract, which are not expressly amended herein, shall remain in full force and effect. Water Planning, Strategic Developments and Asset Management Engineering Manager City of Fort Worth Water Department 200 Texas Fort Worth, TX 76012 RE: City of Fort Worth Water Department Water and Wastewater Installation Policy and Design Criteria Update City Secretary Contract#49554 Amendment#2-Additional Services Request Kimley-Horn No. 069098199 Dear Wendy: Throughout this project, there have been multiple items requiring additional services that were not previously identified in the original contract. We are requesting your consideration to amend our contract to allow for additional services related to final coordination with T/PW, a training session, a DAC presentation, preparation of a list of recommended revisions to existing City documents, and final document formatting and revisions. Coordination with T/PW The original contract included provisions for up to three(3) meetings with the City to review revised sections of the updated documents, as well as provisions for Kimley-Horn to address one(1)round of City review comments. Due to changes in the proposed typical water main placement, additional coordination with T/PW is required. In addition, Kimley-Horn anticipates the revision of multiple exhibits to address any T/PW comments.These services were not included in the original scope of services. City of Fort Worth Training Session Upon acceptance of the final document by the Development Advisory Committee(DAC), Kimley-Horn will prepare for and conduct one(1)training session on the updated Installation Policy and Design Criteria for Water,Wastewater, and Reclaimed Water Infrastructure.This was not included in the original scope of services. DAC Presentation and Document Revisions The original contract included provisions for up to 3 meetings with the City to review revised sections of the updated documents with DAC. Due to the significant number of changes proposed and detail associated with the various sections, Kimley-Horn will prepare and present a summary of the updated document to DAC. In addition, Kimley-Horn will address all DAC comments and compile the final document. Ms. Wendy Chi-Babulal, P.E., October 70, 2018, Page 2 Kimsey>>>Horn Preparation of List of Recommended Revisions to Existing Documents The original contract included provisions for the preparation of a list of recommended ordinance revisions to be consistent with the updated document.After the significant number of changes proposed, several specifications and standard details are also no longer consistent. Kimley-Horn will review of the final document and summarize necessary changes to existing ordinances, specifications, and standard details to ensure they are consistent with the updated document. Document Formatting and Revisions Document formatting was previously agreed to upon commencement of the original contract. However, due to the number of changes and volume of information contained in the document, an alternate format was recommended. Kimley-Horn will prepare a new format and update the final draft to match the new formatting. The additional amount requested for the outline additional services above is$30,000,and is summarized below. DISCUSSION: On August 15, 2017, (M&C C-28333) the City Council authorized an engineering services agreement with Kimley-Horn and Associates Inc., for Water and Wastewater Policy and Design Criteria Update in the amount not to exceed $199,500.00. The agreement was subsequently revised by Amendment No. 1 in the amount of$85,000.00, which was administratively authorized on July 19, 2018. Amendment No. 1 additional services included the review, development and incorporation of stakeholder input related to urban infill and shared access easements. Amendment No. 2 in the amount of$30,000.00 will provide for additional document revisions based on stakeholder input, staff training sessions, coordination with other Departments, and stakeholder presentations. The updated Water and Wastewater installation policy and design Criteria is anticipated to be complete by December 2018. This Project is located in ALL COUNCIL DISTRICTS. FISCAL INFORMATION /CERTIFICATION: The Director of Finance certifies that funds are available in the current operating budget, as appropriated, and funds will be made available in the Fiscal Year 2019 operating budget of the Water and Sewer Fund. Prior to an expenditure being made, the department has the responsibility to validate the availability of funds.
