WORTH,TX 4b ADDENDUM TO ORDER FORM BETWEEN THE CITY OF FORT WORTH AND WEST PUBLISHING CORPORATION d/b/a WEST GOVERNMENT SERVICES Notwithstanding any language to the contrary in the attached Order Form presented by West Publishing Corporation(Contractor) for the;Vest Complete print products("Product Package"), the City of Fort Worth ("City") and Contractor(collectively the "parties") hereby stipulate by evidence of each Party's performance, i.e. the City's acceptance of materials from Contractor or payment to Contractor for the same and Contractor's provision of the materials described on the Order Form or acceptance of payment from City for the same, that the Order Form and this Addendum shall make up the Agreement between the Parties and that in the case of any conflict between the terms of the Order Form and this Addendum, the terms of this Addendum shall control. City's signature on the attached Order form is conditioned upon the inclusion of the terms contained in this Addendum. 1.Prohibition on Contracting with Companies that Boycott Israel:Contractor acknowledges that in accordance with Chapter 2270 of the Texas Government Code,the City is prohibited from entering into a contract with a company for goods or services unless the contract contains a written verification from the company that it: (1)does not boycott Israel; and (2) will not boycott Israel during the term of the contract. The terms"boycott Israel"and"company"shall have the meanings ascribed to those terms in Section 808.001 of the Texas Government Code. By signing this contract, Contractor certifies that Contractor's signature provides written verification to the City that Contractor: (1)does not boycott Israel; and (2)will not boycott Israel during the term of the contract. 2. Indemnity: Nothing herein shall require the City to indemnify or hold Contractor or any third party harmless from damages of any kind or character. 3.Right to Audit: Contractor agrees that the City shall,until the expiration of three(3)years after final payment under this Agreement,have access to and the right to examine any directly pertinent books, documents, papers and records of Contractor involving transactions relating to this Agreement. Contractor agrees that City shall have access during normal working hours to all necessary Contractor facilities and shall be provided adequate and appropriate workspace in order to conduct audits in compliance with the provisions of this section. The City shall give Contractor reasonable advance notice of intended audits.
