HomeMy WebLinkAboutContract 51824 CITY CI-Cp�"rA qY � I CONT iAL;T E J. _.SL ._ !..9a THE STATE OF TEXAS COUNTY OF TARRANT INTERLOCAL AGREEMENT FOR THE PAVING OF PARKING LOT AND DRIVEWAY ENTRANCE AT CHAMBERLIN PARK BACKGROUND This Agreement is between Tarrant County, Texas ("COUNTY") acting by and through its duly authorized County Commissioner Court, and the City of Fort Worth, Texas ("CITY") acting through its duly authorized Assistant City Manager. WHEREAS, the CITY and the COUNTY have agreed to pave a parking lot and driveway entrance at Chamberlin Park comprising of approximately 69,664 square feet. Collectively, hereinafter referred to as the"Project". WHEREAS, the Interlocal Cooperation Act contained in Chapter 791 of the Texas Government Code provides legal authority for the parties to enter into this Agreement; and WHEREAS, During the performance of the governmental functions and the payment for the performance of those governmental functions the parties will make the performance and payment from current revenues legally available to that parry; and WHEREAS, the Commissioners Court of the COUNTY and the City Council of the CITY each make the following findings: a. This Agreement serves the common interest of both parties; b. This Agreement will benefit the public; C. The division of costs fairly compensates both parties to this Agreement; and d. The CITY and COUNTY have authorized their representative to sign this Agreement. COUNTY RESPONSIBILITY COUNTY will furnish the labor and equipment for the following"Project". COUNTY will furnish materials not to exceed$200,000.00: COUNTY agrees to place 8" Hot Mix Asphaltic Concrete on approximately 37,608 SF of driving lane consisting of 6"Type 'B' Base Course and 2" Type `D' Surface Course in addition to placing 6" Hot Mix Asphaltic Concrete on approximately 32,056 SF Parking Area consisting of 4"Type'B' Base Course and 2" Type 'D' Surface Course. 2. CITY RESPONSIBILITY 2.1 The City shall perform or cause to be performed surveying,preparation of the subgrade and placement of all curb and gutter prior to county moving in, staking and installation of erosion control measure. 2.2 The City shall construct or cause to be constructed concrete curbs and gutters. 2.3 The City shall perform or cause to be performed striping and site improvements. 2.4 The City will furnish a site for dumping waste materials generated during this "Project"in close proximity to the"Project" site. 2.5 The City will furnish all necessary rights of way,plan specifications and engineering drawings. 2.6 The City will furnish necessary traffic controls, including Type A barricades, to redirect traffic flow to alternate lanes during the construction phase of the "Project" if necessary; and 2.7 The City will provide necessary temporary driving lane markings. 2.8 The City will pay the COUNTY$150.00 for equipment and man-hours. 2.9 If a Storm Water Pollution Prevention Plan ("SWPPP") is required,the City will be responsible for the design and development of the SWPPP. The City will pay for all cost (including subcontractor materials, labor and equipment) associated with the implementation and maintenance of the SWPPP. 3. PROCEDURES DURING"PROJECT" 2 COUNTY retains the right to inspect and reject all materials provided for this "Project". If CITY has a complaint regarding the construction of the "Project",the CITY must complain in writing to the COUNTY within 30 days of"Project" completion. Upon expiration of 30 days after"Project" completion,the CITY becomes responsible for maintenance of the "Project"within their respective jurisdiction. 4. NO WAIVER OF IMMUNITY This agreement does not waive COUNTY rights under a legal theory of sovereign immunity. This agreement does not waive either City's rights under a legal theory of sovereign immunity. 5. OPTIONAL SERVICES 5.1 If necessary,COUNTY will furnish flag persons 6. TIME PERIOD FOR COMPLETION CITY will give the COUNTY notice to proceed at the appropriate time. However, COUNTY is under no duty to commence construction at any particular time. 7. THIRD PARTY The parties do not enter into this agreement to protect any specific third party.The intent of this agreement excludes the idea of a suit by a third party beneficiary. The parties to this agreement do not consent to the waiver of sovereign immunity under Texas law to the extent any party may have immunity under Texas law. 8. JOINT VENTURE&AGENCY The relationship between the parties to this agreement does not create a partnership or joint venture between the parties. This agreement does not appoint any party as agent for the other party. 9. EFFECTIVE DATE This agreement becomes effective when signed by the last party whose signing makes the agreement fully executed. 3 i t 10. TERMINATION OF AGREEMENT This Agreement shall automatically terminate upon completion of the "Project" or one (1) year from the date of this agreement, whichever is first. This Agreement may be renewed prior to its expiration upon the mutual consent of the parties. (2014 BOND PROGRAM) DISCUSSION: On June 20, 2017, (M&C C-28294), the City Council authorized execution of an Architectural Services Agreement with HKS, Inc., in the amount of$799,261.74 to provide architectural design and construction administration services for the new Como Community Center. On June 5, 2018, (M&C C-28717), the City Council authorized execution of an Construction Manager at Risk Construction Contract with Muckleroy & Falls, in the Not-to-Exceed Amount of$10,183,044.00, to Provide Construction Services for the new Como Community Center. The purpose of this M&C is to authorize the City Manager or his designee to enter into an Interlocal Agreement with Tarrant County relative to the County's participation in the construction of parking lot improvements associated with the Como Community Center project. Tarrant County has offered to furnish $200,000.00 of materials, and the associated equipment and labor necessary with an estimated value up to $150,000.00 to complete asphalt paving for the project. The remainder of the parking lot improvements will constructed by the City's contractor as part of the project. There will be no financial impact to the City. Tarrant County is agreeing to do this work at no cost to the City. The new Como Community Center will be located in Chamberlin Park (COUNCIL DISTRICT 3). Tarrant County, Texas, acting by and through the Tarrant County Commissioners Court, has been advised of the following described Project involving the construction, improvement, or repair of a building, road or other facility. In accordance with Texas Government Code § 791.014, Tarrant County hereby gives its specific written approval for the Project prior to the Project beginning.
