HomeMy WebLinkAboutContract 35189-A2 AMENDMENT NO. 2 STATE OF TEXAS S CITY SECRETARY CONTRACT (M&C Needed) COUNTY OF TARRANT $ WHEREAS, the City of Fort Worth (City) and Dunaway Associates, L.P. , (Engineer) made and entered into City Secretary Contract No. 35189, (the Contract) which was authorized by the City Council by M&C C-21991 on the 6th day of March 2007 ; and WHEREAS, the Contract involves engineering services for the following project: Engineering Design Services : Seepage Analysis Study and Report on Citywide Seepage and Study Improvements, Project No. 04489; DOE No. 5429 WHEREAS, it has become necessary to execute Amendment No. 2 to said Contract to include an increased scope of work and revised maximum fee; NOW THEREFORE, City and Engineer, acting herein by and through their duly authorized representatives, enter into the following agreement which amends the Contract: 1 . Article I of the Contract is amended to include the additional engineering services specified in a proposal letter dated September 12, 2008, a copy of which is attached hereto and incorporated herein. The cost to City for the additional design services to be performed by Engineer total $18,520 . 00 . 2 . Article II of the Contract is amended to provide for an increase in the maximum fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall not exceed the sum of $81,425.00 . The Storm Water Utility group has requested the following additional services related to the investigation of groundwater seepage sites at various locations around the city. Item 1. Additional Seepage Sites SWU staff requested investigation of 10 additional seepage sites. Locations of these sites will be identified by SWU at a later date. Dunaway will visit these sites and perform the following services: a. Documentation of existing conditions with photographs, field notes, and sketches. b. Determination of the source of the water based on available evidence. c. Determination of closest available locations to divert groundwater (inlets, drainage channels) Item 2. Seepage Study Report SWU staff requested a modification of the report already submitted to include the following additional topics: a. Definition of seepage and seepage source. b. Description of types of problems caused by seepage (infrastructure damage, vehicular safety, pedestrian safety, nuisance). c. Development of a standard form for field data acquisition. d. Development of a scoring system for each problem type listed in Task b. e. Developrnent of typical recommendations for seepage repair. f. K t R \ 2 U u City of Fort Worth, Texas Mayor and Council Communication COUNCIL ACTION: Approved on 121912008 DATE: Tuesday, December 09, 2008 LOG NAME: 20AMEND2CITYWID REFERENCE NO.: **C-23217 SUBJECT: Authorize Amendment No. 2 in the Amount of $18,520.00 to Contract No. 35189 with Dunaway Associates, L.P., for Storm Water Utility Project — Citywide Seepage Study RECOMMENDATION: It is recommended that the City Council authorize the City Manager to execute Amendment No. 2 in the amount of$18,520.00 to City Secretary Contract No. 35189 with Dunaway Associates, L.P., for storm water utility project - Citywide seepage study, thereby revising the total cost to $81,425.00. DISCDSSIDN: The Storm Water Management Program was established to reduce flooding in Fort Worth, preserve streams, minimize water pollution and to operate the storm water system in a more effective manner to fully comply with state and federal regulatory requirements. This will be accomplished by infrastructure reconstruction and system maintenance, master planning, enhanced development review, and increased public education and outreach. The City has encountered seepage issues throughout the City. A study of specific sites was recommended to evaluate and prioritize the sites. Dunaway Associates, L.P., was selected from the consultants who had submitted a Statement of Qualifications for the 2004 C I P Request for Qualifications. On March 6, 2007, the City Council authorized the City Manager to execute an engineering agreement with Dunaway Associates, L.P., for a City-wide Seepage Study. On July 5, 2007, the City Manager executed administratively Amendment No. 1 to the engineering agreement with Dunaway Associates, L.P., in the amount of $24,500.00 for the design of Catalina Court Drainage. On October 16, 2007, the City Council approved the issuance and sale of bonds which will be used to fund capital improvements in the storm water utility system scheduled over the next two years. Staff has requested the consultant to increase the scope of the Seepage Study. Amendment No. 2 of the subject engineering agreement will provide investigation of 10 additional sites and modification of the report to include additional tasks. The additional tasks will include the following: definition of seepage and seepage source, description of types of problems caused by seepage, development of standard field data acquisition form, development of a scoring system for each problem, development of typical recommendations for seepage repair, development of typical construction details, prioritization of all sites, and preparation of concept level construction costs for each site. City staff considers the fee to be fair and reasonable for the scope of services proposed. In addition to the contract amount, $1,852.00 is required for project management by the Transportation and Public Works Department. This project is located CITYWIDE.
