TO CITY SECRETARY CONTRACT
WHEREAS, the City of Fort Worth (CITY) and EJES, Inc. ,
(ENGINEER) made and entered into City Secretary Contract No.
35138, (the CONTRACT) which was authorized by M&C C-22015 on the
20th day of March, 2007 in the amount of $160, 650 . 00; and
WHEREAS, the CONTRACT was subsequently revised by:
Amendment Number 1 in the amount of $20, 560.00 which was
administratively authorized and Amendment No. 2 in the amount of
$9, 905. 00 which was administratively authorized on August 3,
2011; and
WHEREAS, the CONTRACT involves engineering services for
the following project:
Water and Sanitary Sewer Replacement Contract 2005, WSM--L;
and
WHEREAS, it has become necessary to execute Amendment No.3
to the CONTRACT to include an increased scope of work and revised
fee.
NOW THEREFORE, CITY and ENGINEER, acting herein by and
through their duly authorized representatives, enter into the
following agreement, which amends the CONTRACT:

Article I of the CONTRACT is amended to include the
additional engineering services specified in a proposal dated
August 28, 2013, a copy of which is attached hereto and
incorporated herein. The cost to City for the additional design
services to be performed by Engineer totals $12,060. 00.

Article II of the CONTRACT is amended to provide for an
increase in the fee to be paid to Engineer for all work and
services performed under the Contract, as amended, so that the
total fee paid by the City for all work and services shall be an
amount of $203, 175.00.

All other provisions of the Contract, which are not
expressly amended herein, shall remain in full force and effect.
EXECUTED and EFFECTIVE as of the date last written by a

Dear Mr. Chaubey:
Per your request we are pleased to submit this Amendment No. 3 for additional design services required to
complete the above referenced project, The requested modifications will be outside of our scope of services
as set forth in City Secretary Contract No. 35138 and as amended by City Secretary Contract No. 35138-
A2, therefore this Amendment No. 3 is being developed to further identify these services and summarize the
associated costs. The additional services required to prepare final construction documents will include the
following:
• Modify design to add 8"water line replacement from existing 8"water line on Colonial Parkway south of
Country Club Circle to Park Hill Drive
• Modify remaining plan sheets to conform to new sheet numbering,project limits and construction notes
• Revise contract documents&specifications
• Revise summary of quantities and cost estimate
■ Obtain Topographic Survey
We are requesting your assistance in the execution of this Amendment No. 3 in order for us to expeditiously
perform these services.
The attached EXHIBIT I, outlines the additional tasks, personnel and man-hours we anticipate to be
required to make the requested revisions to the construction documents. The total fee for these additional
services will bean amount not to exceed 112,060. In order to avoid any further delay in the project
schedule, EJES, Inc. will proceed to make the requested revisions outlined above at this time.

These Amendment No. 3 services will be performed with the good faith understanding that an executed
agreement for additional compensation is forthcoming and will be received prior to submittal of the final
documents. The total contract amount to date, including amendments, is as follows:
Original Contract Amount = $160,650.00
Amendment No. 1 = $20,560.00
Amendment No. 2 = $9,905.00
Amendment No. 3 = $12.060.00
New Contract Amount = $203.175.00
