Re: Airplane Sculpture — First Flight Park
Dear Richard:
This letter confirms that Elan West 7th, L.P. ("Elan") claims no ownership interest in that
certain airplane sculpture (the "Sculpture") located in First Flight Park and that there are no
artist rights in the Sculpture. Elan and the City of Fort Worth (the "City") entered into that certain
LICENSE AGREEMENT BETWEEN THE CITY OF FORT WORTH AND ELAN WEST 7T", L.P. FOR THE
DEVELOPMENT OF PARK IMPROVEMENTS IN FIRST FLIGHT AND LINWOOD - JESSIE D. SANDOVAL
PARKS (the "License Agreement") on December 24, 2015. Under the License Agreement, Elan
was obligated to construct certain Discretionary Improvements in the City parks as described in
the Agreement. Elan constructed those Improvements and conveyed them to the City as
referenced in Document No. D216175988 filed in the Real Property Records of Tarrant County,
TX.
Separate and apart from the License Agreement and the Discretionary Improvements
described therein, Elan, the City's Park & Recreation Department, and the Fort Worth Aviation
Museum partnered to facilitate the assembly and construction of the Sculpture located in First
Flight Park (the "Park"). No artist was commissioned to create the Sculpture. Rather, Cowtown
Aerocrafters was engaged to assemble the Sculpture which is simply a replica of a historic
Bleriot XI airplane from the early 1900s. This letter serves as confirmation that Elan claims no
ownership interest in the Sculpture and that there are no artist rights to the Sculpture.
