FIFTH AMENDMENT TO
CITY SECRETARY CONTRACT NO.
47622
THIS FIFTH AMENDMENT to City Secretary Contract No. 47622 is entered into by
and between the City of Fort Worth ("City"), a home-rule municipality in the State of
Texas, acting through Valerie Washington, its duly authorized Assistant City Manager,
and Progressive Environmental Services, Inc. dba SWS Environmental Services
("Contractor"), acting through Daniel R. Mahanor, its duly authorized Vice President.
WHEREAS, the City and Progressive Environmental Services, Inc. dba SWS
Environmental Services have entered into that certain agreement identified as City
Secretary Contract No. 47622 (also the "Contract") commencing on March 21, 2016 for
services involving emergency hazardous waste spill response services;
WHEREAS, City Secretary Contract No.47622 provides for the extension of the term of
the Contract for up to four additional periods of one year each; and
WHEREAS, the parties are currently in the third term of the Contract which expires
March 20, 2019; and
WHEREAS, the parties now wish to exercise the third annual extension option of the
Contract; and
WHEREAS, the parties agree that all other conditions, terms, and timeline shall
remain the same as stated in City Secretary Contract No. 47622 —A4.
NOW, THEREFORE, for and in consideration of the mutual covenants contained
herein, and other good and valuable consideration, the receipt and sufficiency of
which are hereby acknowledged and confessed, the parties hereto agree as follows:
1. Compensation Not to Exceed Amount:
The not to exceed amount for this Contract shall be a total amount not to exceed
$85,000.00 for each annual term as set forth in City Secretary Contract No. 47622-
A4.
2. Extended term of contract:
City Secretary Contract number 47622-A4 is extended to include the term beginning
March 21, 2019 and ending March 20, 2020.

3. Miscellaneous:
All other definitions, terms, and conditions of City Secretary Contract number 47622-
A4 shall remain unchanged except as expressly set forth herein.
IN WITNESS THEREOF, the parties have executed this contract in triplicate in Fort
Worth, Texas, on the dates written below.
