FOURTH ADDENDUM TO CITY SECRETARY
CONTRACT NO. 50758
This Fourth Addendum to City Secretary Contract Number 50758 ("Agreement") is by and
between the City of Fort Worth ("City"), a home-rule municipality organized under the laws of
the State of Texas, acting by and through its duly authorized Assistant City Manager, and
Displays LLC, acting through Pamela Suggs, its Director of Operations (the "Contractor"). The
City has designated the Arts Council of Fort Worth and Tarrant County, Inc. as its Contract
Manager to manage this agreement on its behalf.
WHEREAS, on May 20, 2017, the City and Contractor entered into City Secretary
Contract ("CSC") Number 50758 (CSC No. 50758), whereby Contractor agreed to provide
specific services for the purpose of assisting with the care and maintenance of the Public Art
Collection, one Renewal (CSC No. 50758-R2), one Amendment (CSC 50758-AIAD2), and
three Addenda(CSC 50758-ADI, CSC 50758-A1AD2, and 50758-AD3);
WHEREAS, the City is in need of services as specified in this Fourth Addendum
(collectively"Services");
WHEREAS, City owns and maintains a public Artwork titled Golden Assembly
("Artwork") by Eric Eley ("Artist") which is sited in Rosen Park, located at 2200 McCandless
St, Fort Worth, TX 76114 ("Site");
WHEREAS, the Artwork is an installation of functional tables and benches made from
compositional lumber, a picture of Artwork is attached hereto as Exhibit"I;"
WHEREAS, City wishes to repair and replace damaged sections of the Artwork with
materials leftover from the original installation and in the City's possession;
WHEREAS, Contractor has provided an estimate to repair and replace damaged
materials in the Artwork, as necessary,which is attached hereto as Exhibit"J;" and
WHEREAS, the City and Contractor wish to set out the Services to be provided per the
Agreement that will be specific to this Fourth Addendum with the intent that further Services
may be requested by the City through future addenda;
NOW, THEREFORE, in consideration of the mutual covenants and agreements
hereinafter set forth, the sufficiency of which is hereby acknowledged, the parties agree as
follows:
I.
Contractor hereby agrees to provide the City with professional services for repairs to the
Artwork, as outlined in Exhibit"J," Contractor's Estimate, which is attached hereto and
incorporated within as if copied in full.
II.
Contractor shall notify City, through its Contract Manager, in writing when the repairs
are complete.

III.
All terms and conditions of the Agreement not specifically addressed herein remain in
full force and effect and are binding upon the parties.
IN WITNESS WHEREOF, the parties hereto have executed five copies of this Fourth Addendum in
Fort Wolth,Texas,on day of .2018.
