JUSTIFICATION(REASONS)FOR'CHANOEiORDER- ""
This change order is needed to address low concentrations of soil contaminants discovered during construction activities which required
removal and caused a 33-day delay in the construction schedule.Ground water is to be temporarily contained with a soil berm to prevent any
discharge into Lebow Creek and the West Fork of the Trinity River.The contamination needs to be removed promptly to prevent any
unauthorized discharge.Contractor shall be required to enter into a separate agreement with the City for the discharge of the contaminated
groundwater into the City's sanitary sewer system.
This change order includes costs for expedited testing of the water and soil,and dewatering of the construction pit.Contractor shall adhere to
Utility Trench Excavation,Embedment and Backfill Spec,33 0510 for all work performed for this change order,as well as any other local,state,
or federal law or regulation.

It is understood and agreed that the acceptance of this Change Order by the contractor constitutes an accord and satisfaction and represents payment
in full(both time and money)for all costs arising out of,or incidental to,the above Change der.
