RENEWAL ONE TO CITY SECRETARY CONTRACT NO. 50603
This Renewal is entered into by and between the City of Fort Worth (hereafter
"City"), a home rule municipal corporation situated in portions of Tarrant, Denton and
Wise Counties, Texas, with its principal place of business at 200 Texas Street, Fort
Worth, Texas, and HVAC Service Pro, (hereafter "Contractor"). City and Contractor
may be referred to herein individually as a"Party" and collectives as the "Parties."
WHEREAS, the City Council authorized the City Manager or his Designee to
enter into a Contract with Contractor for an initial one-year term with two (2) one-year
renewal options to support the City's Rehab Programs (M&C P-12170);
WHEREAS, the Parties previously entered into City of Fort Worth City
Secretary Contract No. 50603 (the "Contract"), which was executed on or about April 4,
2018, for construction services for the City's Rehab Programs;
WHEREAS, the Parties entered into the First Amendment to the Contract on
June 19, 2018, to include program guidelines and requirements associated with the City's
Home Crisis Repair Program;
WHEREAS, the Parties entered into the Second Amendment to the Contract on
January 16, 2019, to revise Attachment "C," Bid Price Worksheet, of the Contract to add
pricing information for materials not listed on the original Bid Price Worksheet, and to
update pricing information for selected items;
WHEREAS, Article 5 of the Contract provides that the Contract shall be
renewable at the City's option, and upon Contractor's written acceptance for up to two
(2) additional one-year terms;
WHEREAS, the Parties desire to renew the Contract for an additional 1 year
period from April 4, 2019 through April 3, 2020 pursuant to the terms of the original
Contract; and
NOW, THEREFORE, City and Contractor, acting herein by the through their
duly authorized representatives, agree to the following:
I.
The Contract, as amendmended, is hereby renewed for an additional 1 year period
beginning April 4, 2019 and expiring April 3, 2020, unless earlier terminated in
accordance with the Contract.
