FIRST AMENDMENT AND FIRST RENEWAL OF
CITY SECRETARY CONTRACT NO. 50716
A NON-EXCLUSIVE MOWING AND GROUNDS MAINTENANCE SERVICES
AGREEMENT BETWEEN THE CITY OF FORT WORTH AND
ABESCAPE GROUP LLC
This FIRST AMENDMENT AND FIRST RENEWAL OF CITY SECRETARY
CONTRACT NUMBER 50716("First Amendment and First Renewal") is made and entered into by and
between THE CITY OF FORT WORTH ("City"), a home-rule municipal corporation of the State of
Texas, acting by and through its duly authorized Assistant City Manager, and ABESCAPE GROUP
LLC ("Contractor") a Texas limited liability company, acting by and through its duly authorized
representative.
WHEREAS, effective April 23, 2018, the City and Contractor entered into a non-exclusive
mowing and grounds maintenance services agreement, City Secretary Contract Number 50716
("Agreement");
WHEREAS, the Agreement provides for a primary term of one year, beginning on April
23, 2018 and expiring on April 22, 2019, with four(4) subsequent four-year renewal options;
WHEREAS, the parties desire to exercise the first one-year renewal option;
WHEREAS, Contractor has requested an increase in compensation during the first
renewal term as authorized by the Agreement;
WHEREAS, the parties desire to amend the Agreement to correct the length of the
renewal terms;
NOW, THEREFORE, the City and Contractor agree to amend the Agreement and
renew and extend the Agreement for the first renewal term as follows:
I.
Section 3 of the Agreement is amended to be and read as follows:
3.1 Term. The term of this Agreement shall begin on April 23, 2018 and expire on
April 22, 2019 ("Term"), unless terminated earlier in accordance with the
provisions of this Agreement. This Agreement may be renewed for four
additional one-year periods upon written agreement of the City and Contractor.
II.
The City and Contractor agree to renew and extend the Agreement for a first renewal
term of one (1) year, effective beginning on April 23, 2019 and ending on April 22, 2020 ("First

Renewal Term"). During the First Renewal Term, City will pay Contractor an increase in the
amount of two and three-tenths of a percent(2.3%) above the prices contained in the Agreement.
III.
1. All other terms and conditions of the Agreement shall remain in full force and
effect except as specifically set forth in this First Amendment and First Renewal.
2. All terms of this First Amendment and First Renewal that are capitalized but not
defined shall have the meanings assigned to them in the Agreement.

IN WITNESS WHEREOF, the parties hereto have executed this First Amendment and
First Renewal to be effective on the date signed by the City's Assistant City Manager.
