AMENDMENT TO CITY SECRETARY CONTRACT NO. 49814 UNIFIED SIGN AGREEMENT This AMENDMENT TO UNIFIED SIGN AGREEMENT is entered into by and between the CITY OF FORT WORTH, a municipal corporation of the State of Texas located within Tarrant, Denton, Parker, Johnson and Wise Counties, Texas (hereinafter referred to as the "City.") acting herein by and through its duly authorized City Manager or duly designated representative, and SUMMER CREEK STATION, LLC, a Texas limited liability company (hereinafter referred to as "Company") acting herein by and through its duly authorized representative. RECITALS WHEREAS, the City of Fort Worth ("City") and Summer Creek Station, LLC ("Company") made and entered into City Secretary Contract No. 49814 Unified Sign Agreement("Agreement")on October 23.2017;and WHEREAS, Exhibits in the Agreement include the legal description for the property and exhibits that depicts the sign type, height, width and locations of the allowable signage within the Property; and WHEREAS, the Company is seeking to revise the location of two monument sign located on Lot 5A, Block 13, along Sycamore School Road and Lot 13, Block 13, along Summer Creek Drive, as depicted in the exhibit entitled "Summer Creek Station Retail Center,"(Sheet 1 through 7)of the Agreement due to the location of easements;and WHEREAS, it advisable to amend the agreement to label the exhibits to conform with the designations prescribed in the body of the agreement;and WHEREAS, it advisable to execute this Amendment to the Agreement to revise the exhibit in the Agreement depicting the revised dimensions of the sign types allowed within the Property due to the location of easements;and u� R 4PI?,qC� Amendment No. 1 to CSC.49814 crh cF 20�9 Unified Sign Agreement OFFICIAL RECORD cr�js�C� �,a9rH CITY SECRETARY qY FT. The exhibits included in the original agreement are hereby ascribed the following exhibit labels: 1. The exhibits of the legal descriptions of the property and written description of the project shall be labeled"Exhibit A." 2. The exhibit entitled"Summer Creek Station Retail Center", sheets I through 7, shall be labeled collectively"Exhibit B" 2. Exhibit B, depicting the types of allowable signage on the Property and their respective dimensions and locations, is hereby revised and amended with Exhibits B-I and B-2 attached hereto and incorporated herein to the Agreement. 3. All other provisions of the Agreement which are not expressly amended herein shall remain in fall force and effect. This Unified Sign Agreement covers real property located at: Southwest Corner of Sycamore School Road and Summer Creels Drive, Fort Worth, Texas and more particularly described in Exhibit "A "attached hereto and made a part hereof for all purposes (the "Property"). 2. Summer Creek Station, LLC, a Texas limited liability company (the "Owner"), whose address is: Post Office Box 93898, Southlake,T%76092, is the owner of all the Property subject to this Unified Sign Agreement. 3. Signs shall be constructed on the Property in accordance with the sign plan attached hereto as Exhibit "B" (the "Sign Plan"). No signs shall be constricted on the Property or allowed to remain on the Property, except as reflected on the Sign Plan. 4. All parties hereto covenant and agree that the Property covered by this Unified Sign Agreement will be collectively treated as a single premises for the limited purpose of determining the number, size and location of on-premise signs permitted in accordance with Section 6.404(F) of the Comprehensive Zoning Ordinance of the City of Fort Worth, being Ordinance No. 13896, as amended. 5. The covenants, limitations and restrictions contained herein shall be covenants running with the land with respect to the Property and shall be binding on Owner and all parties having any right, title or interest in or to the Property, or any part thereof, and their heirs, successors and assigns. 6. Owner agrees to defend, indemnify and hold harmless the City of Fort Worth from and against all claims or liabilities arising out of or in connection with this Unified Sign Agreement. 7.
