HomeMy WebLinkAboutContract 47615-A4 pa1N CSCO#: 47615-A4 OVOp tp��`Y'YATE OF TEXAS car( § § KNOWN ALL BY THESE PRESENTS: COUNTY OF TARRANT § FOURTH AMENDMENT TO CITY SECRETARY CONTRACT NO. 47615 THIS FOURTH AMENDMENT to City Secretary Contract No. 47615 is entered into by and between the City of Fort Worth ("City"), a home-rule municipality in the State of Texas, acting through Valerie Washington, its duly authorized Assistant City Manager, and US Ecology of Houston, Inc. ("Contractor"), acting through Kenneth Knibbs, its duly authorized Vice President of Technical Services. WHEREAS, the City and US Ecology of Houston, Inc. have entered into that certain agreement identified as City Secretary Contract No. 47615 (also the "Contract") commencing on March 15, 2016 for services involving emergency hazardous waste spill response services; and WHEREAS, City Secretary Contract No. 47615 provides for the extension of the term of the agreement for up to four additional periods of one year each; and WHEREAS the parties are currently in the third term of the Contract; and WHEREAS the parties wish to increase the not-to-exceed amount of the Contract; and WHEREAS, the Third Amendment to City Secretary Contract No. 47615 provided for the third annual contract term renewal commencing on March 16, 2018; and WHEREAS, the parties agree that all other conditions, terms, and pricing shall remain the same as stated in City Secretary Contract No. 47615-A3. NOW, THEREFORE, for and in consideration of the mutual covenants contained herein, and other good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged and confessed, the parties hereto agree as follows: 1. Extended term of contract: City Secretary Contract number 47615 is extended to include the fourth term beginning March 16, 2019 and ending March 15, 2020. 2. Compensation Not to Exceed Amount: The not-to-exceed amount for this contract shall be increased by $35,001.00 for a total amount not to exceed $85,000.00 for each term. The new not-to-exceed amount shall be retroactively applied to the term of this renewal authorized by City Secretary Contract No. 47615.
