understand that the provision of water by the City of Fort Worth shall be made in strict compliance with
Chapter 35 of the Fort Worth City Code (1986), as amended, specifically but not limited to the following
Sections:
1. City Code Section 35-60"Uses Outside City'as applicable;and
2. City Code Section 35-20"Provisions Incorporated into Consumer Contracts".
"All of the provisions of this Chapter [35] shall be deemed to be incorporated in every contract
between the city and its water or sanitary sewerage service customers, and each customer or
consumer shall be charged with knowledge of the provisions of this chapter and, by applying for
and accepting water or sanitary sewerage service from the city, to have assented to the
provisions of this chapter." This shall include any and all ordinances adopted and amending
Chapter 35 such as ARTICLE VI. LAWN AND LANDSCAPE IRRIGATION CONSERVATION.

A strip of land twenty (201) feet wide over. under and across a portion of Lot 31.
El Rancho Estates according to plat recorded in Volume 386-11. Page 266 of the Tarrant t
County Plat Records and conveyed to David H. McCracken ie Volume 2166, page 333 of
the Deed Records of Tarrant County. Texas. Sais strip of land is ten (10 ) Feet
right and ten (101) feet left and parallel to the center line described below a
sanitary sewer providing a twenty (20*1 foot►ride permanent easement for construct-
ing. operating, maintaining and r+epairinq said sanitary sewer With the usual ,
appurtenances and necessary connections thereto.
The center line of said sanitary sewer is as follows: ;
eEBINNING at a point in the test property tine of Lot 31. E1 Rancho Estates, an the #
west right-of-way line of Diamond Bar Trail, said point being N 60 00' E 24.05 feet
from the S.E. corner of said Lot 31.
THENCE: N 890 10' 1611 W. a distance of 177.6 feet to a point.
THENCE: S 790 34' 45" W, a distance of 12.0 feet to a point. �-
THENCE: S 190 19' 46" W. a distance of 66.21 feet to the beginning of a curve #
having a radius of 240.0 feet, f
THENCE: Along the are of said curve to the left, through a central angle of
426 oe', a distance of 176.49 feet to the point of tangency of said
corner.
THENCE: S 370 26' 450 W, a distance of 27.3 feet to a point on the west property
line of said Lot 31.
It is further agreed and understood that the City of Fort Worth, Texas will be
permitted the use of an additional ninety (901) feet wide north of and west of
Parallel and adiacent to the center line described above as a temporary construction
easement for constructing the said sanitary sewer. Upon ca"letion of the con-
struction of the said sanitary serer and its acceptance by the City Council of the `
City of Fort Worth, Texas, all rights conveyed within the said temporary construction
easement shall cease and all aiporations, maintenance and repairs of said sanitary !
sewer shall be confined to the above described twenty (201) foot wide permanent
easement.
Permanent easement contains 9.192 sq. feet
Temporary construction easement contains 44,609 sq. feet (1.02 Acres).

Authorize the Provision of Sewer Service at 1.25 Times the Retail Rate to Mr. Steve McLaurin to
Serve His Personal Residence Located at 6985 Horseshoe Trail South, in Tarrant County, Outside
of the Fort Worth City Limits, Pursuant to City Code Section 35-60B "Uses Outside City"
RECOMMENDATION:
It is recommended that the City Council:
1. Authorize the Water Department to provide sewer service at 1.25 times the retail rate to Mr. Steve
McLaurin to serve his personal residence located at 6985 Horseshoe Trail South, located in Tarrant County,
outside of the Fort Worth City limits; and
2. Authorize the City Manager to execute an agreement for such services.
DISCUSSION:
Mr. Steve McLaurin has submitted a request to receive sewer service from the City of Fort Worth for his
personal residence located at 6985 Horseshoe Trail South.
The legal description of the property is Lot 31 of El Rancho Estates, located in the extraterritorial jurisdiction
of Tarrant County (see attached map).
Mr. Steve McLaurin has agreed to pay all fees and charges associated with the connection. The applicant
also understands that the fees and the monthly bill will be 1.25 times the rate for customers inside the City
of Fort Worth until such time as the property may be annexed.
This property is located adjacent to COUNCIL DISTRICT 3.
FISCAL INFORMATION/CERTIFICATION:
The Finance Director certifies that the Water Department will be responsible for collection of funds due to
the City as a result of this agreement.
