WHEREAS, the City of Fort Worth (CITY) and CDM Smith Inc . (formerly
Camp Dresser & McKee Inc. ) (ENGINEER) made and entered into City
Secretary Contract No. 36010, (the CONTRACT) which was authorized by M&C
C-22433 on the 2nd day of October, 2007 in the amount of $4, 992, 954 . 00;
and
WHEREAS, the CONTRACT involves engineering services for the
following project:
Westside Water Treatment Plant and Raw Water Pipeline Design; and
WHEREAS, it has become necessary to execute Amendment No. 3 to the
CONTRACT to include an increased scope of work and revised fee.
NOW THEREFORE, CITY and ENGINEER, acting herein by and through their
duly authorized representatives, enter into the following agreement,
which amends the CONTRACT:

Article I of the CONTRACT is amended to include the additional
engineering services specified in a proposal dated June 21, 2013, a copy
of which is attached hereto and incorporated herein. The cost to City
for the additional design services to be performed by Engineer totals
$139, 000 . 00 .
2 .
Article II of the CONTRACT is amended to provide for an increase in
the fee to be paid to Engineer for all work and services performed under
the Contract, as amended, so that the total fee paid by the City for all
work and services shall be an amount of $5, 757, 954. 00.
3 .
All other provisions of the Contract, which are not expressly
amended herein, shall remain in full force and effect .

SUBJECT: Authorize Execution of Amendment No. 3 with COyW Smith, Inc., in the Amount of
$139.000.00to City Secretary No. 36010. an Engineering Agreement, for Additional
Construction and Start-Up Services Required to Support the VVeeteide Water Treatment
Plant Construction Contract (ETJ Near COUNCIL DISTRICT 3)
RECOMMENDATION:
It is recommended that the City Council authorize the execution Amendment No. 3 to the Engineering
Agreement with COyN Smith, Inc., for additional construction and start-up services required to support
the VVeeteide Water Treatment P|ant, in the amount of$139.00O.00. thereby increasing the amount of
the contract from $5.618.954.00to $5.757.954.00.
DISCUSSION:
On October 3. 2007. (yN&C C-22433) the City Council authorized the City Manager to execute an
Engineering Agreement with Camp Ovaeeer& McKee, Inc. (name later changed to COW1 8nnbh. Inc.),
in the amount of$4.993.954.00 for the design of the VVesteide Water Treatment Plant. On June 23.
2009 (W1&C C-23623). City Council authorized the City Manager to execute the construction contract
for the VVeeteide Water Treatment Plant.
Amendment No.1. authorized by City Council on May 18. 2010. (W1&C C-24243) compensated COyN
Smith, Inc., for extra work required to redesign theVVeeteide Plant plans and repackage and rebid the
construction contract. Amendment No. 2, authorized by City Council on July 10. 2012 (yN&C C-
35709). compensated COW1 Smith, Inc., for additional costs associated with providing construction
services for a longer construction contract duration than was included in the original scope of work.
Amendment No. 3, consists of extra work associated with finalizing construction acUvidee, plant
startup and equipment testing, troubleshooting issues during initial operaUon, and preparation of
record documents and drawings.
W1/VVBE Office- C[>W1 Smith, Inc., is in compliance with the City'e W1/VVBE Ordinance by committing to
an additional five percent W1/VVBE participation on this Amendment No. 3 in which COW1 Smith, |nc'e.
overall W1/VVBE participation on this project is 30 percent. The City'e W1/VVBE goal on this project is 28
percent inclusive of all Amendments.
This project is located in the City'e extra-territorial 'uried|ction, one quarter mile west of the
intersection of Old Weatherford Road and Chapin Road, in unincorporated Tarrant County, W1apeco
71F.
FISCAL .
The Financial Management 8en/icae Director certifies that funds are available in the current capital
budget, as appropriated, of the Water Capital Projects Fund.
