This First Amendment of City Secretary Contract No. 51510 ("First Amendment") is by and
between the City of Fort Worth("City"), a home-rule municipal corporation of the State of Texas, acting
by and through its duly authorized Assistant City Manager, and Chris Powell, an individual ("Artist").
The City has designated the Arts Council of Fort Worth & Tarrant County, Inc., to manage this
Agreement on its behalf.
WHEREAS, on November 9, 2018, the City and Artist entered into a professional services
agreement to provide a revised final site design for the reinstallation of Elements that are part of the
Artist's original public art installation(the "Agreement");
WHEREAS, on April 8, 2019, the Fort Worth Art Commission approved the Revised Final Site
Design;
WHEREAS, Artist is responsible for providing storage for Elements until an implementation
plan is approved; and
WHEREAS, City desires to amend the compensation terms to allow Artist to provide continued
storage;
NOW, THEREFORE, in consideration of the mutual covenants herein expressed, the Parties
agree to amend the Agreement as follows:
I.
Revise Section 3.2 of Article 3 "Compensation and Payment Schedule" of the Agreement to
amend the payment schedule. Section 3.2 is hereby amended, in whole,to read as follows:
"City agrees to pay Artist in the following installments set forth below, each installment to
represent full and final, non- refundable payment for all services and materials provided prior to the due
date thereof:
a. SIX HUNDRED AND FORTY-NINE DOLLARS AND NO CENTS($649. 00)upon
execution of this Agreement.
b. SIX HUNDRED AND FORTY-NINE DOLLARS AND NO CENTS ($649. 00)within
thirty(30)calendar days after City's approval of the Revised Final Site Design.
c.City may pay Artist up to FOUR THOUSAND AND NO DOLLARS ($4,000.00)for
engineering and consulting fees in order to fulfill the terms of this Agreement. Such payment
shall be made upon receipt of an invoice from Artist with the original invoice(a retainer fee of up
to 50%is allowed)for such services attached thereto.
d. City will provide an allowance of up to THREE THOUSAND `Tc-0-DOLLAR
($3,000.00) for fees related to storage and revisions to the attachment N' based on the)

engineer's stamped drawings. Such payment shall be made upon receipt of an invoice from Artist
with original invoices for such services attached thereto."

Funds previously paid to Artist prior to this First Amendment shall apply toward the total
compensation paid to Artist.
III.
All terms and conditions of the Agreement that are not expressly amended pursua>xt to this First
Amendment shall remain in full force and effect.
IV.
All terms in this First Amendment that are capitalized but not defined shall have the meanings
assigned to them in the Agreement.
IN WITNESS WHEREOF,the parties hereto have executed four copies of this First Amendment in Fort
Worth, Texas,this aay of 2019.
