(No M&C Needed) COUNTY OF TARRANT § WHEREAS, the City of Fort Worth (City) and TCB, Inc., formerly known as Turner, Collie & Braden, Inc., (Engineer) made and entered into City Secretary Contract No. 31833 (the Contract) which was authorized by the City Council by M&C C-20660; and WHEREAS, the Contract involves engineering services for the following project: Pavement Reconstruction and Water and Sanitary Sewer Replacement on Provine Street (Normandy Road to Ederville Road), Norma Street (North Hughes Avenue to North Edgewood Terrace), Morris Court (Rand Street to East Dead End) WHEREAS, it has become necessary to execute Amendment No. 2 to said Contract to include a net decreased scope of work and revised maximum fee; NOW THEREFORE, City and Engineer, acting herein by and through their duly authorized representatives, enter into the following agreement which amends the Contract: 1. Article I of the Contract is amended to include the revised scope in engineering services specified in a proposal letter dated May 30, 2007, a copy of which is attached hereto and incorporated herein. The reduction in cost to City for the revised scope of services to be performed by Engineer total $13,500.00. 2. Article II of the Contract is amended to provide for a reduction in the maximum fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall not exceed the sum of $133,712.40. --- r Contract Amendment No. 2 Page 1 of 2 3. Prior to the bidding phase, TCB had recommended that storm drain improvements be part of the construction documents, and they were included as an alternate bid. After the job was bid, the City of Fort Worth decided to incorporate some storm drain improvements along Provine Street, and increase the design criteria from a 5-yr to a 100-yr storm. A meeting was held on November 14, 2006 to discuss the inclusion of these storm drain improvements into the construction project(Attachment A). As a result of that meeting, the City requested that TCB provide a scope and fee to redesign the storm drain improvements along Provine Street to contain flows from a 100-year event. The scope and fee were provided in a previous request dated November 21, 2006. At the same meeting, there was a discussion in regard the capacity of the existing outfall pipe that drains storm water from Provine Street to an existing 54-inch line located west of Ederville Road. This existing outfall pipe does not have adequate capacity to carry the 100-year flows from the proposed Provine Street storm drain system to the 54-in line. TCB was asked to prepare a scope and fee to redesign the outfall to convey the 100-year storm. TCB prepared a scope and fee for the proposed outfall pipe and combined it with the November 21, 2006 agreement. The combined agreement was termed Supplemental Agreement No. 1 and the executed amendment was signed on February 19, 2007 (Attachment B). The work in Supplemental Agreement No.1 included the following tasks and associated fees: Tasks Fee S-Curve and 100- r flows 1. Revise horizontal S-curve on Provine Street $3,850 2. Redesign storm drain to contain 1 00- r flows $7,640 Subtotal of Task 1 and 2 $11,490 Upgrade Outfall Pipe 3. Survey $2,764 4. Easement $2,270 5. Design and modify Provine plans $8,466 Subtotal of Task 3, 4, and 5 $13,500 TOTAL OF SUPPLEMENTAL AGREEMENT NO. 1 $24,990 Upon execution of Supplemental Agreement No. 1, the City of Fort Worth gave TCB the Notice to Proceed for only Tasks 1 and 2. The City asked TCB to hold off on the remaining tasks. With regard to Tasks 3, 4, and 5, the City of Fort Worth contacted TCB on May 16, 2007 and requested that these tasks be performed under a separate contract. Based on this request,TCB will prepare a separate proposal to perform the work necessary to design the outfall pipe. Mr. Richard Argomaniz, PE May 30, 2007 Page 2 This letter has been written to formally amend the February 19, 2007 Executed Supplemental Agreement No. 1 to exclude the work and fees necessary to design the Outfall Pipe. The February 19, 2007 Executed Supplemental Agreement No. 1 should be reduced from a total of$24,990 to a total $11,490. Currently, the section of roadway between Ederville Road and Normandy Road contains one pair of inlets located at a sump near mid-block. Based on the drainage calculations performed during design, TCB recommended that additional inlets be installed along Provine on either side of the sump. Because the required construction budget may not be available to include the additional storm drain, and because no drainage issues have been reported in this area based on the City's database, the City requested that the additional inlets and associated storm drain pipe be included in the bid as an alternate. Bids have been received and the low bidder, Gilco Contracting, Inc. submitted a bid for the drainage improvements along Provine of$74,461.60. Below is a discussion of the elements of the meeting. Argomaniz gave an overview and update of the project. Bids have been received, but have not yet been awarded due to Water Department funding issues. The M&C was prepared without the inclusion of the additional storm drain improvements at the request of TPW staff. Since the time of the bid opening, Argomaniz and Jann attended an on-site meeting with several homeowners that live along Provine. During this meeting, the residents noted that flooding issues were present during most rain events, especially near the"S" curve and location of the sump. Jann noted that based on the calculations, the roadway did not have the adequate capacity to carry flows generated by a 5-year storm event in accordance with City of Fort Worth drainage criteria without the additional inlets. Jaafari questioned whether an increase in the roadway width from the Page 2 proposed 28-feet up to the existing 30-foot width would provide adequate capacity for the flows thereby meeting the drainage criteria. Jann noted that this difference in capacity between the two sections was negligible and would not address the drainage issue. Based on COFW drainage criteria, the design would require the 100-year event to be contained within the ROW. Due to the existing grades, Provine Street was designed with split curbs. Eubanks noted that because the roadway utilized a split curb design the 100-year event flows would most likely not be contained within the ROW. Further he noted that the inlets and storm drain pipe should be designed to contain flows from a 100-year event. Eubanks also questioned the capacity of the existing storm drain pipe connecting the existing sump inlets to the outfall at the City owned lake across Ederville Road. Based on the total 100-year flows calculated, it appears that this line would not have sufficient capacity to carry the flows once the improvements along Provine are implemented. Eubanks noted that his group is agreeable to provide funding for the storm drain improvements along Provine Street in addition to an upgrade of the storm drain pipe from the sump to the outfall. The re-designed storm drain improvements along Provine will be included in the construction of the roadway. The upgrade of the storm drain line may be included in the construction of the roadway, or based on the schedule, may be constructed as part of another project. TCB will provide the City with a request for supplemental authorization to re-design the storm drain improvements along Provine to contain the 100-year event. In addition, TCB will determine the need for an upgrade to the existing outfall pipe. TCB will also provide a scope and fee to design the upgrade to this line. TCB '
