Home My WebLink AboutContract 52038-A1 RECEIVED CITY SECRETARY JUL 2 3 2019 GUNTRACT NO., 5=3— AA myo FmT\NOW FIRST AMENDMENT CIV SECRETARY TO CITY SECRETARY CONTRACT NO. 52038 RIGHT-OF-WAY ENCROACHMENT AGREEMENT This FIRST AMENDMENT TO CITY SECRETARY CONTRACT NO. 52038, ENCROACHMENT AGREEMENT is made and entered into by and between the CITY OF FORT WORTH, a home rule municipal corporation of Tarrant County, Texas("City"-acting herein by and through its duly authorized City Manager, Assistant City Manager, or Planning and Development Director, and Texas Christian University,a(n)Non-profit Corporation("Licensee"), acting herein by and through its duly authorized Vice Chancellor for Finance and Administration. RECITALS WHEREAS, City and Licensee made and entered into City Secretary Contract No. 52038 on March 13, 2019(the "Agreement"),to authorize the use of the Public Right-of-Way for the purpose of providing underground electric for future development and WHEREAS,the parties wish to amend the Agreement to address installation of new conduit; and WHEREAS, it is the mutual desire of City and Licensee to execute this Amendment to the Agreement to revise"Exhibit A" in the Agreement to depict the revised encroachment area. NOW,THEREFORE,City and Licensee,acting herein by and through their duly authorized representatives,enter into the following that amends the Agreement: 1. "Exhibit A" in the Agreement is hereby replaced with the attached revised description of the encroachment area, labeled as"Revised Exhibit A." 2. OFFICAA.1, ')7rn D cilry FT. All other provisions of the Agreement which are not expressly amended herein shall remain in full force and effect.
