HomeMy WebLinkAboutContract 36191 AMENDMENT No. 1 THE STATE OF TEXAS § CITY SECRETARY CONTRACT NO.aL A I (No M&C Needed) COUNTY OF TARRANT § WHEREAS, the City of Fort Worth (City) and Freese and Nichols, Inc., (Engineer) made and entered into City Secretary Contract No. 33246, (the Contract) which was authorized by the City Council by M&C 21249 on the loth day of January, 2006; and WHEREAS, the Contract involves engineering services for the following project: Construction Management for the Eagle Mountain Water Treatment Plant, Raw Water Pump Station, Raw Water Intake, and Raw Water Transmission Main WHEREAS, it has become necessary to execute Amendment No. 1 to said Contract to include an amended scope of work, with no change to the maximum fee; Construction Management for the McCart Avenue Pump Station and Ground Storage Tank NOW THEREFORE, City and Engineer, acting herein by and through their duly authorized representatives, enter into the following agreement which amends the Contract: 1. Article I of the Contract is amended to delete certain items of work and to add those additional engineering services specified in the proposal letter dated November 5, 2007, a copy of which is attached hereto and incorporated herein. There is no net charge to the contract amount associated with this change in the scope of work. RE: Eagle Mountain Water Treatment Plant Construction Management Project No. P164-060164052003/City Secretary Contract#33246 Amendment No. 1 for McCart Avenue Pump Station and Ground Storage Tank Project No. P264-6061600050183 and P264-6061800050180 Construction Management Services FNI No. FTW05340 Phase 4 Dear Mr. Harder: We are pleased to submit this scope of services as Amendment No. 1 to the Eagle Mountain Water Treatment Plant Construction Management Services Contract (City Secretary Contract #33246) to provide Construction Management Services for the McCart Avenue Pump Station and Ground Storage Tank Project. As discussed, we propose to provide the following services: 3.07 • Provide part-time (20 hrs weekly) on-site resident representation services for the twelve month construction project. • Provide part time clerical/technical support. • Provide materials testing services. • Provide part time specialty civil/mechanical/electrical/structural and general consulting services as needed for assistance and observations by the Design Consultants. • Prepare record drawings. The FWWD will provide one part time resident representative (labor and expenses) observing the project, working an average of 20 hours per week for a period of 12 months. Mr.Chris Harder,P.E. Construction of the pump station and storage tank began in August 2007 and will be completed in August 2008. The bid cost of the construction project is $5,341,000. Adequate funds remain, at this time, in the original Eagle Mountain Construction Management Contract to provide these additional services without increasing that Contract Amount. Surplus funds are available because the extent of field inspection services was less than estimated for the intake, pump station, and pipeline construction projects and less materials testing and field surveys were required. The proposed cost ceiling of the Phase 4 services is $308,783. This is 5.78% of the construction cost. The amendment's proposed M/WBE participation is $52,072, or 16.86%. Compensation for this phase of services: Labor: Salary Cost times 2.20. Construction Manager: Flat rate of $166/hour for construction phase and $172/hour for warranty phase.
