HomeMy WebLinkAboutContract 51983-A1 CITY FCCRETARY SEP 26 Z019 OFFRR��NOR FIRST AMENDMENT TO CITY SECRETARY CONTRACT NO.51983, EASEMENT ENCROACHMENT LICENSE AGREEMENT This FIRST AMENDMENT TO CITY SECRETARY CONTRACT NO. 519831 EASEMENT ENCROACHMENT LICENSE AGREEMENT is made and entered into by and between the CITY OF FORT WORTH, a home rule municipal corporation of Tarrant County,Texas ("City"), acting herein by and through its duly authorized City Manager, Assistant City Manager,or Planning and Development Director, and ACH Landowner III,a(n)nonprofit corporation("Licensee"), acting herein by and through its duly authorized CEO. RECITALS WHEREAS, City and Licensee made and entered into City Secretary Contract No. 51983 on March 1, 2019 (the"Agreement"),to authorize the use of the City's easement for the purposes of establishing a security fence along the north eastern corner of the site and provide a data conduit underneath Mighty Mite Drive connecting to the adjacent eastern lot 4R2; and WHEREAS,the parties wish to amend the Agreement to install an additional security fence along the northwest corner of the site; and WHEREAS,it is the mutual desire of City and Licensee to execute this Amendment to the Agreement to revise"Exhibit A"in the Agreement to depict the revised encroachment area. NOW,THEREFORE,City and Licensee, acting herein by and through their duly authorized representatives, enter into the following that amends the Agreement: 1. "Exhibit A"in the Agreement is hereby replaced with the attached revised description of the encroachment area, labeled as"Revised Exhibit A." E J13 2. The effective date of this Amendment shall be the date of its execution by the City. 3. All other provisions of the Agreement which are not expressly amended herein shall remain in full force and effect.
