c'' RIGHT-OF-WAY ENCROACHMENT AGREEMENT
This FIRST AMENDMENT TO CITY SECRETARY CONTRACT NO. 49084-A1,
ENCROACHMENT AGREEMENT is made and entered into by and between the CITY OF FORT
WORTH, a home rule municipal corporation of Tarrant County, Texas("City"),acting herein by and
through its duly authorized City Manager, Assistant City Manager, or Planning and Development
Director, and COOK CHILDREN'S HEALTH CARE SYSTEM, a(n)Domestic Nonprofit
Corporation("Licensee"),acting herein by and through its duly authorized Vice President,
Construction and Real Estate.
RECITALS
WHEREAS, City and Licensee made and entered into City Secretary Contract No.49084-A1 on
July 26, 2019(the"Agreement"),to authorize the use of the Public Right-of-Way for providing power
conduits,data conduits, irrigation lines,fiber optic lines and irrigation heads to service a parking lot to the
west; and
WHEREAS,the parties wish to amend the Agreement to include four electric conduits and 2'
clearance of sanitary sewer in alley;and
WHEREAS, it is the mutual desire of City and Licensee to execute this Amendment to the
Agreement to revise"Exhibit All in the Agreement to depict the revised encroachment area.
NOW,THEREFORE,City and Licensee, acting herein by and through their duly authorized
representatives,enter into the following that amends the Agreement:
1.
"Exhibit A" in the Agreement is hereby replaced with the attached revised description of the
encroachment area, labeled as"Revised Exhibit A."

The effective date of this Amendment shall be the date of its execution by the City.
3.
All other provisions of the Agreement which are not expressly amended herein shall remain in
full force and effect.
