WHEREAS, the City of Fort Worth (CITY) and Dunaway Associates, L. P. ,
(ENGINEER) made and entered into City Secretary Contract No. 36513, (the
CONTRACT) which was authorized by the City Council by M&C C-22600 on the
8th day of January, 2008 in the amount of $726, 110 . 00; and
WHEREAS, the CONTRACT was subsequently revised by: Amendment Number 1
in the amount of $7, 757 . 00 which was administratively authorized by the
City on the 19th day of March 2009, Amendment Number 2 in the amount of
$110, 428 . 00 which was authorized by M&C C-24123 on the 9th day of March
2010, Amendment Number 3 in the amount of $25, 524 . 00 which was
administratively authorized by the City on the 30th day of September
2011, Amendment Number 4 in the amount of $155, 902 . 00 which was
authorized by M&C C-25627 on the 5th day of June 2012, Amendment Number 5
in the amount of $17, 705 . 00 which was authorized by M&C C-26125 on the
5th day of March 2013, Amendment Number 6 in the amount of $42, 750. 00
which was authorized by M&C C-26555 on the 12th day of November 2013,
Amendment Number 7 in the amount of $61, 375. 00 which was authorized by
M&C C-26753 on the 8th day of April 2014; Amendment Number 8 in the
amount of $13, 420 . 00 which was administratively authorized by the City
on the 5th day of September 2014; and Amendment Number 9 in the amount of
$20, 056. 00 which was administratively authorized by the City on the loth
day of September 2015; and
WHEREAS, the Contract involves engineering services for the following
project:
East First Street from Beach Street to Oakland Boulevard; and
WHEREAS, it has become necessary to execute Amendment No. 10 to said
Contract to include an increased scope of work and revised fee.
NOW THEREFORE, CITY and ENGINEER, acting herein by and through their
duly authorized representatives, enter into the following agreement,
which amends the Contract:

Article I of the Contract is amended to include the additional
engineering services specified in the proposal dated January 22, 2016,
copies of which is attached hereto and incorporated herein. The cost to
City for the additional design services to be performed by Engineer
totals $33, 460 . 00 . (See Attached Funding Breakdown Sheet, Page -3-) .

Article II of the Contract is amended to provide for an increase in
the fee to be paid to Engineer for all work and services performed under
the Contract, as amended, so that the total fee paid by the City for all
work and services shall be an amount of $1, 214, 487 . 00 .

All other provisions of the Contract, which are not expressly amended
herein, shall remain in full force and effect.

This letter constitutes our request for supplemental authorization for tasks outside and in
excess of the scope of services for the current contract and amendments.
This request is based upon the following items:
SCOPE OF SERVICES
1.0 Construction Phase Engineering
After the East First Street project was approved for construction and awarded to SEMA
construction, the number of RFI's and request for Change rapidly depleted the budget
set aside for construction phase services. As of the date of this letter,there have been
twenty-nine (29)RFIs and seven(7)Change Orders, requiring additional coordination
and issuing TxDOT-requested plan revisions that were not included in the shop
drawing reviews and site visits as originally scoped. In addition,TxDOT has requested
revisions and resubmittals of plan sheets that in our opinion did not affect the
constructability of function of the project.
It is estimated that the construction will require approximately twelve to fifteen months
to complete. In order to continue addressing RFI's and producing plan revisions as
requested by TxDOT,we will need additional budget to be billed on an hourly basis not
to exceed $33,050. This fee includes $5,000 for the M/WBE firm Aguirre & Fields for
plan revisions related illumination, small signs, and pavement markings.

Authorize Execution of an Engineering Services Agreement with Dunaway Associates,L.P., for the Design of
East First Street from Beach Street to Oakland Boulevard (2004 CIP Project No. 00145)
RECOMMENDATION:
It is recommended that the City Council authorize the City Manager
to execute an Engineering Services Agreement with Dunaway
Associates, L.P., in the amount of$726,110 for the design of East
First Street from Beach Street to Oakland Boulevard.
DISCUSSION:
The 2004 Capital Improvement Program(CIP) included$890,000 for
the design, construction and inspection of East First Street from
Beach Street to Oakland Boulevard.A The existing two—lane rural
roadway will be reconstructed to a four—lane divided
roadway.A Additionally,the project will include the construction of a
new bridge over the Trinity River.A Tarrant Countya€TMs 2006 Bond
Program approved$2,090,000 to supplement the completion of this
project.A Federal funding for this project is $2,397,335 bringing the
total available funding to$5,377,335.
On April 25, 2006,the City Council (M&C C-21412) adopted
Resolution No. 3338-04-2006 authorizing the execution of a Local
Transportation Project Advance Funding Agreement(LPAFA) with
the Texas Department of Transportation (TxDOT) for a Surface
Transportation Program/Metropolitan Mobility Project for East First
Street from Beach Street to Oakland Boulevard.
As part of the total federal funding for this project, TxDOT will
reimburse the City 80 percent of the design costs of$726,110, and
will advertise, award and inspect construction of the roadway with
the new bridge over the Trinity River(Bridge ID
02220ZZ0075002).A The remaining federal funding for this project
will be allocated for construction.A The City, as part of its cost, will
be responsible for all costs of acquiring right—of—way,relocating
utilities, mitigating environmental impacts and paying for all cost
overruns.
The original estimated cost of the project is $3,044,598.A Due to the
cost of construction inflation and environmental issues, the design,
construction and inspection costs are currently estimated at
$5,079,235.A The remaining$298,100 will cover the cost of project
management, acquiring right—of—way,relocating utilities, mitigating
environmental impacts and paying for all cost overruns.
Based upon review of written Statement of Qualifications,Dunaway
Associates,L.P., was selected as the best qualified firm to perform
the design work for this project.A Dunaway Associates,L.P., has
proposed to perform the necessary surveys, geotechnical
investigations, environmental documents,final plans and
specifications for a lump sum fee of$726,110.A City Staff considers
this fee to be fair and reasonable for the scope of services to be
performed.
Dunaway Associates,L.P.,is in compliance with the Citya€TMs
M/WBE Ordinance by committing to 35 percent M/WBE
participation on the agreement.A The Citya€TMs goal on this
agreement is 28 percent.
This project is located in COUNCIL DISTRICT 4,Mapsco 64S, T, U
and V.
FISCAL INFORMATION/CERTIFICATION:
The Finance Director certifies that funds are available in the current
capital budget, as appropriated,of the Street Improvements Fund.
