HomeMy WebLinkAboutContract 46319-A2 N0� ,5 2p19 SST`T{SSSS�A�� AMENDMENT NO.2 TO CITY SECRETARY CONTRACT NO. 46319 STATE OF TEXAS § § CITY SECRETARY CONTRACT NO. � COUNTY OF TARRANT § WHEREAS,the City of Fort Worth("City")and SLF IV—Chisholm Trail,L.P.("Owner") made and entered into a Transportation Impact Fee Credit Agreement,City Secretary Contract No. 46319 (the "Agreement");and WHEREAS, Amendment 1 (City Secretary Contract No. 46319-A1) to reallocate certain credits was executed on March 12,2019;and WHEREAS, it has become necessary to execute this Amendment No.2 to said Agreement, as amended,to reallocate certain credits and replace Exhibit"F-1"with Exhibit"F-2"attached to this Amendment 2. NOW THEREFORE, City and Owner, acting herein by and through their duly authorized representatives, enter into the following agreement that amends the Agreement: 1. The definition of"Property" in the Agreement is hereby modified to remove the tract of land described on Exhibit "A-1" attached hereto ("Tract 15"). All exhibits to the Agreement are hereby deemed to be amended to remove Tract 15 therefrom. 2. $203,280.00 of credits have been allocated to Tract 5 (approximately 10.39 acres), an additional $463,380.00 of credits have been allocated to Tract 8A(for a total of$1,071,610.37 of credits allocated to Tract 8A), and$617,245.54 of credits have been allocated to Tract 6A (approximately 20.42 acres), as shown in Exhibit"F-2"attached hereto, leaving an unallocated balance of$0.00, subject to reallocation by Owner in accordance with the Agreement.
