HomeMy WebLinkAboutContract 50918-A2 SECOND AMENDMENT "`' TO CITY SECRETARY CONTRACT NO.50918 EASEMENT ENCROACHMENT LICENSE AGREEMENT This SECOND AMENDMENT TO CITY SECRETARY CONTRACT NO. 50918, EASEMENT ENCROACHMENT LICENSE AGREEMENT is made and entered into by and between the CITY OF FORT WORTH, a home rule municipal corporation of Tarrant County,Texas ("City"), acting herein by and through its duly authorized City Manager,Assistant City Manager, or Planning and Development Director, and Village Homes,LP, a(n)Limited Partnership("Licensee"), acting herein by and through its duly authorized President. RECITALS WHEREAS,City and Licensee made and entered into City Secretary Contract No. 50918 on June 26,2018(the"Agreement"),to authorize the use of the City's easement for the purposes of constructing,placing, and maintaining an iron and masonry fence which will fence private residential front yards located at 4237,4233,4229 and 4225 Watercourse Drive 76109; and WHEREAS,City and Licensee made and entered into City Secretary Contract No. 50918-A1 on May 22,2019(the"Agreement"),to amend the Agreement to extend the fence to private residential front yards located at 4125,4129,4133 and 4141 Watercourse Drive 76109 and to install awnings and overhangs for the roof eaves; and WHEREAS,the parties wish to amend the Agreement to extend the fence, awnings,and overhangs to private residential properties located at 4145,4149,and 4153 Watercourse Drive 76109; and WHEREAS,it is the mutual desire of City and Licensee to execute this Amendment to the Agreement to revise"Exhibit A"in the Agreement to depict the revised encroachment area. NOW,THEREFORE,City and Licensee,acting herein by and through their duly authorized representatives,enter into the following that amends the Agreement: 1. OFNL AL RECORD f 0TV SECRETARY FT WORTH,TX "Exhibit All in the Original Agreement, as amended by City Secretary Contract No. 50918-A1, is hereby replaced with the attached revised description of the encroachment area,labeled as"Second Revised Exhibit A." 2. The effective date of this Second Amendment shall be the date of its execution by the City. 3. All other provisions of the Original Agreement, as amended by City Secretary Contract No. 50918-A1,which are not expressly amended herein shall remain in full force and effect.
