HomeMy WebLinkAboutContract 47384-A1 C€TY SECRETARY RECEIVED C�.-I RACTNO., 47384--Al � 0262019 CITYOFFORTWORTH ,� CITYSECPOARY e" FIRST AMENDMENT TO THE LEASE AGREEMENT Oi 6 8 1, - WHEREAS,the City of Fort Worth, a Texas home rule municipal corporation("Lessee") entered into a certain Lease Agreement dated December 24, 2015 (City Secretary Contract No. 47384), with Fort Worth Housing Authority("Lessor") for leased premises Iocated at 5004 Ave. G, Fort Worth,Texas, 761205 to be used by the Fort Worth Police Department as office space, more particularly described in the Lease("Leased Premises); and WHEREAS, that certain Lease(as amended by subsequent renewals and modifications) expires effective October 31,2019; and WHEREAS,the Lessee and Lessor desire to add five(5)additional automatic successive one(1)year renewals to expire October 31,2024, NOW THEREFORE, in consideration of the rentals set forth in the Lease, the parties agree to amend the lease as follows: SECTION 3.Term (b) This Lease provides for two (2)successive one(1) year automatic renewal terms, which renewals were properly exercised, and which the final renewal term shall expire on October 31,2019.The parties hereby agree that the Lease be amended to provide for five(5) additional automatic,successive,one(1)-year renewal terms,which final renewal term shall expire October 31,2024. Each renewal term shall automatically occur unless Tenant or Landlord provides written notice to the other party of the intent not to renew in not less than 30 days prior to the beginning of the next renewal term. SECTION 10.Default.Termination. Funding and Non-Appropriation (c)Termination:The first sentence is amended as follow: Lessor and Lessee shall have the right to terminate this lease at any time for any reason by giving the other party written notice 30 days prior to the intended termination date. All other terms and conditions of the Lease remain unchanged and in full force and effect. WORTH,TX Official site of the City of Fort Worth,Texas CITY COUNCIL AGENDA FORT�RTH DATE: 11/19/2019 REFERENCE **M&C 19- LOG NAME: 215004 AVENUE G NO.: 0320 LEASE AMENDMENT CODE: L TYPE: CONSENT PUBLIC NO HEARING: SUBJECT: Authorize An Amendment to Extend the Term of the Lease Agreement with the Housing Authority of the City of Fort Worth DBA Fort Worth Housing Solutions for the Office Space Located at 5004 Avenue G, Cavile Place Apartments, Fort Worth, Texas, 76105 for the Police Department (COUNCIL DISTRICT 5) RECOMMENDATION: It is recommended that the City Council authorize an amendment to the lease agreement with the Housing Authority of the City of Fort Worth DBA Fort Worth Housing Solutions, to extend the term for the office space located at 5004 Avenue G, Cavile Place Apartments, Fort Worth, Texas, 76105 for the Police Department(COUNCIL DISTRICT 5) DISCUSSION: The Property Management Department, at the request of the Police Department, negotiated a lease agreement commencing on December 24, 2015 (City Secretary Contract No. 47384), with the Housing Authority of the City of Fort Worth DBA Fort Worth Housing Solutions ("FWHS")for leased premises located at 5004 Ave. G, Fort Worth, Texas, 76105 to be used by the Fort Worth Police Department ("FWPD") as office space. That Lease (as amended by subsequent renewals and modifications) expires effective October 31, 2019. The FWPD and FWHS desire to extend the lease term and provide a 30 day lease termination option for both parties. Approval of this Mayor and Council Communication will amend the lease agreement as follows: 1. Add five (5) automatic successive one (1) year renewals terms to expire October 31, 2024; 2. Provide a thirty (30) day lease termination option for both parties. All other terms and conditions of the lease remain unchanged and in full force and effect. This property is located in City Council District 5. FISCAL INFORMATION/CERTIFICATION: The Director of Finance certifies that approval of these recommendations will have no material effect on City funds.
